Court rules developer misrepresented housing project in brochure
The Kuala Lumpur High Court today ruled in favour of housebuyers who took a developer to court, for misrepresenting a development in a property brochure.
The court instructed Wawasan Rajawali Sdn Bhd, a wholly owned subsidiary of OSK Property Holdings Sdn Bhd, to pay 122 housebuyers RM50,000 each.

The Kuala Lumpur High Court today ruled in favour of housebuyers who took a developer to court, for misrepresenting a development in a property brochure.
The court instructed Wawasan Rajawali Sdn Bhd, a wholly owned subsidiary of OSK Property Holdings Sdn Bhd, to pay 122 housebuyers RM50,000 each.
It also ordered damages for the late delivery amounting to RM1.3 million to the affected buyers.
High Court judge Akhtar Tahir agreed with the housebuyers that Wawasan Rajawali Sdn Bhd had in the brochures misrepresented the project to be a mixed development comprising residences, a hotel, a shopping mall and a central park.
He said the project in Cyberjaya was described as “Your World in One Place”, however, this was not delivered to the housebuyers as promised in the brochures.
Akhtar also ordered Wawasan Rajawali to rectify the defects in the affected properties within three months from today.
One of the homeowners, Sharifah Zakiah Syed Sahab, said the developers should deliver what they promised to the buyers and they must be held responsible for the promises as housebuyers trusted them and invested in the development projects.
“It is very disappointing when they failed to keep their promise as we should get what we invested for,” she said.
The units in the mixed development project were priced between RM300,000 and RM800,000.
The housebuyers were represented by counsel V Rajadevan, while Wawasan Rajawali was represented by lawyer Andrew Chiew.
