The police have submitted thir investigation report on the Sang Saka Malaya flag case to the Attorney-General’s Chambers.

Inspector-general of police Khalid Abu Bakar said the police will wait for the public prosecutor to decide on further action.

On Aug 30, the eve of Merdeka Day, several activists gathered at Dataran Merdeka in Kuala Lumpur to hold an 'alternative' celebration of Malayan independence.

They included national laureate A Samad Said, political activist Hishamuddin Rais and student activist Adam Adli.

The police had arrested the three to record their statements.

Meanwhile, responding to the urging by DAP’s Seputeh MP Teresa Kok to withdraw his claim that there was nothing wrong with the police to interrogate children without parental knowledge, Khalid said he stands firm on his statement.

“She wants me to withdraw (my statement), I will not withdraw my statement,” he said.

Last Thursday, Khalid had publicly defended his men for interrogating SK Seri Pristana students without their parents being present on the grounds that the law did not require them to do so.

In response, Suhakam said that the police may have violated the Child Act 2001 while the Bar Council had explained that provisions in the Criminal Procedure Code (CPC) implied that a child’s guardian should be present when giving statements to the police.

However, Khalid said that the Act has provided the right to the police to question children who are below 18 years old, without the presence of guardian or parents.

He added that the Sexual Investigation Division (D11) is a specifically to investigate cases involving children under the Child Act 2001.

“We are using our common sense now when we are carrying out our job. Sometimes there are also people talking without using their common sense,” he said, responding to Kok’s previous statement to ask the police to use common sense to investigate the case.
