The Kuala Lumpur High Court today has granted an injunction to delay disciplinary proceedings against the four Universiti Kebangsaan Malaysia (UKM) students for allegedly campaigning during the recent Hulu Selangor by-election.

Judge Aziah Ali has granted the injunction, giving the students time to challenge the constitutionality of Section 15(5A) of the University and University Colleges Act (UUCA).

Muhammad Hilman Idham (right) was scheduled to be heard by the university authorities tomorrow.

The three others, Muhammad Ismail Aminuddin, Azlin Shafina Mohamad Adzha and Woon King Chai, were scheduled to face their charges on June 3.

With the injunction all four are now able to make the necessary preparations to challenge the UUCA.  

An inter parte s hearing regarding the injunction is scheduled to take place on June 17 at the Jalan Duta High Court.

Second attempt

Lawyer Ashok Kandiah, who is representing the four students, filed a fresh application for the injunction at the Kuala Lumpur High Court today after the application to the Shah Alam High Court yesterday failed.

The four political science students received a summon on May 13 to face a disciplinary hearing for contravening Section 15(5) of the UCCA.

NONE Muhammad Hilman and Azlin Shafina were arrested at Pekan Rasa on April 22, allegedly for possessing CDs and literature which "expressed support or sympathies" to a certain political party contesting in the by-election. Muhammad Ismail was arrested in Ampang Pecah on the same day in a van which contained political leaflets.

The four had urged the university to drop the charges against them, to no avail, and subsequently sought intervention from the Malaysian Human Rights Commission (Suhakam).

The students claim that their presence at the campaign was part of a field trip to observe the subject of their study first hand.
