A sergeant attached with the armoury section of the Shah Alam district police station told the Shah Alam Sessions Court today that Corporal Jenain Subi was classified as a marksman when using the Heckler & Koch MP5 sub-machine gun.

Sergeant Mohd Sani Mohd Hassan, the tenth witness to testify at the trial of the fatal shooting of teenager Aminulrasyid Amzah, said the accused was tested twice at a shooting range in Jeram, Kuala Selangor.

NONE He said for the sub-machine gun test, a distance of between 25 metres and 30 metres was used, while for the pistol test a distance of 15 metres was used to hit a stationary target.

"Jenain ( left, wearing cap ) was tested twice on the MP5 late last year and early this year and he scored 90 points on both occasions. Having had the score, I could say Jenain is an ahli tembak (marksman)," he said.

On both occasions, however, Jenain, 48, scored lower when using the Walther PPK 95 semi-automatic pistol with scores in the range of the 70s.

'Competent with firearms'

Mohd Sani was testifying at the trial of Jenain who is charged with culpable homicide not amounting to the murder of 15-year-old Aminulrasyid at Jalan Tarian 11/2 , Section 11, between 1.10am and 2am on on April 26.

The charge carries a maximum 30 years jail and a fine on conviction.

Mohd Sani said that if one scores 90 and above on the shooting range for the sub machine gun category, then one could be considered as competent with regards to handling firearms.

He agreed with lawyer M Athimulun that a firearm would not be issued to a policeman if he was not competent.

Although it had not been adduced in court that the weapon resulting in the death of Aminulrasyid is  the MP 5 sub-machine gun, it is the standard equipment used by the police force and also the one issued to Jenain.

The weapon in question is still being kept in wraps, along with the recovered spent bullets.

Malkeet: Aminulrasyid’s body in car

Another witness, Constable Malkeet Singh, who was also one of six officers involved in the car chase, had in the afternoon given slightly different testimony on the positioning of the body when his patrol car arrived at the scene 10 minutes after the shooting.

While paramedic Muhammad Sahid Abdul Karim, had earlier testified today that Aminulrasyid's head was lying face down on the driver’s seat, while his torso was outside the car, this witness gave a slightly different picture.

Malkeet, 25, who was travelling in a Proton Wira police car unit SL 609, said he and Lance Corporal Shamsul Kamar Ismail, were alerted at about 1.50am of police needing assistance to stop Aminulrasyid’s car at Persiaran Sukan.

“We saw two police patrol cars giving chase to a Proton Iswara which came from the direction of the Concorde Hotel towards Persiaran Kayangan.

“Besides Jenain and his partner Muhammad Hafidz Mohd Yusof in the first patrol car, the other patrol car had Corporal Azhar Hashim and Constable Mohd Izham Mahayadin,” he said.

Malkeet said as his car could not immediately follow, he saw the two patrol cars turning into the nearby petrol station in Section 11.

However, he said his patrol car lost sight of the group as it was dark and when they found the place they saw the Proton Iswara had struck a tree near a house 10 minutes later.

“I could see a body inside the car. The head and body was in the car, while the leg was sprawling,” he said, adding that he saw this from a distance.

Malkeet said Shamsul Kamar alighted from the car and went closer while he stayed in the car.

Calling sister

The witness said at that time, he did not see any other occupants in the car.

Aminulrasyid’s friend Azamuddin Omar, who was also in the car had in a press conference said he alighted from the car and was assaulted by four to five policemen. He then managed to escape the police and run into a back lane.

Malkeet testified that he had stayed there for quite some time as more police officers came.

Asked what he did in between waiting while being there, Malkeet replied he was in the car and did personal things.

When asked further by DPP Mohd Dusuki Mokhtar, Malkeet said he had called his sister on his handphone.
