Lawyers representing Baharuddin Ahmad's family filed an application to the High Court yesterday for some documents to be released after finding discrepancies in the testimony of several witnesses at a coroner's inquest.

They want the witness' statement (also known as a 112 statement) recorded by the police from all witnesses.

In addition, they want any documents held by any public authority they may require, in particular those held by Hospital Kuala Lumpur (HKL) where Baharuddin was taken for an autopsy.

NONE Baharuddin is the only fatality during the Bersih 2.0 protest on July 9 last year after he collapsed at the Avenue K building in Kuala Lumpur and attempts to resuscitate him failed.

When contacted, one of the family's lawyers, Ahmad Jufliz Faiza, said the issue arose on Thursday during investigating officer (IO) Sgt-Major Razali Mahmood's testimony to the coroner's court, which contradicted the earlier testimony of Baharuddin's son.

According to the lawyer, Razali told the inquest that Baharuddin's son, Mohd Nasrul Baharuddin, told him that his father had high blood pressure.

This contradicted Mohd Nasrul's testimony on Jan 30 that he told Razali that his father did not suffer from any ailment.

"There must be other discrepancies also that we don't know about," Ahmad Jufliz said when contacted last night.

He added that deputy public prosecutor Ahmad Ishrakh Saad and coroner Zulkpli Abdullah already have the 112 statements, but not his party, therefore it is only fair if his legal team has access to the documents.

He said there was also a discrepancy between the statement of Baharuddin's pathologist and that of another pathologist at the inquest.

Conflicting testimony of pathologists

Dr Khairul Anuar Zainal had testified on March 20 that he performed the autopsy alone and that Baharuddin's remains were the only autopsy that night, and he concluded that Baharuddin died of a heart attack.

However, Ahmad Jufliz said another pathologist, Dr Ferwahn Fairis Abdul Karim, had testified on April 3 that he had assisted Khairul Anuar, and performed an autopsy on another body later that night.

"Our contention is that the autopsy on the other body of a person by the name of Suleiman Ramli was done simultaneously with that of Baharuddin Ahmad," he said.

He said Suleiman died of a heart attack in Petaling Jaya, Selangor and was taken to the University Malaya Medical Centre by ambulance on the same day Baharuddin died, and this raised questions on why police took the body to Hospital Kuala Lumpur that night.

Baharuddin's family lawyers had previously cross-examined Ferwahn Fairis on whether Suleiman's and Baharuddin's hearts were swapped, which he denied.

The lawyers have subsequently applied for a revision of the April 3 coroner's ruling not to allow them to obtain the statements.
