Ipoh Barat MP M Kulasegaran has filed for a judicial review this morning at the Kuala Lumpur High Court, seeking to declare the appointment of five ministers and deputy ministers as unconstitutional.

NONE In his application filed this morning, Kulasegaran ( right ) claimed that all five were neither MPs nor members of the senate when they were appointed to the cabinet by Prime Minister Najib Abdul Razak on May 15.

The five cabinet members comprise two ministers and three deputy ministers- with four of them coming from the Prime Minister's Office (PMO).

The two ministers are Ministers in the Prime Minister's Department Abdul Wahid Omar and Paul Low, while deputy ministers from the same department, Dr Loga Bala Mohan and P Waythamoorthy, were also named.

Kulasegaran also named Deputy Domestic Trade and Consumer Affairs Minister Ahmad Bashah Md Hanipah.

Kulasegaran claimed that the appointment of the five had all violated Article 43 of the federal constitution, which states that any minister or deputy minister must be either an MP or a member of the senate.

Waythamoorthy and Abdul Wahid were both sworn in only on June 5 at Parliament house.

The other three - Ahmad Bashah, Dr Loga Bala, and Paul Low were sworn in on May 21, one week after being appointed to their respective positions by Najib.

Najib appointed all of them when making his announcement for his latest cabinet line-up on May 15 in Putrajaya.

Dewan Negara president Abu Zahar Ujang had previously refused to comment on the legality of their appointments prior to being sworn in, though he had said he would “regularise” the situation in the future.

Low’s appointment, among others, was also questioned by DAP supremo Lim Kit Siang, who also noted that Low was not sworn in as a senator before being appointed.
