After repeated threats by DAP to sue the Registrar of Societies (ROS), the party today announced that it will finally commence legal action.

In a statement, DAP national legal bureau chairperson Gobind Deo Singh said this is over the ROS' refusal to recognise the party's new leadership line-up despite its re-election last year.

He said the ROS also asked DAP central executive committee to refrain from making any decisions until investigation is completed but provided no legal basis for the order.

"DAP made it clear... That it would not be bound by decisions which do not have the force of law and should the ROS fail to respond or provide a proper explanation, DAP, given the far reaching consequences of such a decision, would take the matter to court.

"Despite the significance of the matter and the gravity of the position, the ROS failed to respond," he added.

        

Gobind said a letter on this was received by the ROS on Dec 24.

"Silence gives rise to the impression that the ROS cannot justify its decision. It also raises more questions over the legality or otherwise of the said decision and the conduct of the ROS against DAP thus far.

"This leaves DAP with no choice but to go to court.. DAP will as such, seek a judicial pronouncement to this effect," he said.

Gobind said DAP sees ROS' refusal in recognising the party's leadership and asking that they refrain from making any decisions as unlawful.

DAP had in September last year held a re-election after the ROS demanded that it do so following a botched tallying process at its initial party election in 2012.

DAP complied with the request out of concern that the party will be de-registered but the remedial action did not resolve the tussle with ROS.
