In a statement, the Padang Serai MP, who is also a lawyer, said that the state executive council is still functioning as normal as there no constitutional requirement for the exco members to tender their resignation following Abdul Khalid’s sacking from his party, PKR.
Abdul Khalid is currently waiting to find out his fate after a royal council meeting at the Selangor palace today to determine his status as MB.
“In the meantime, the state exco and government continue to function as usual. It is incorrect to suggest that Selangor has no government because of Khalid’s sacking,” Surendran stressed.
“Article 53(6) of the Selangor constitution states that when the MB ceases to command confidence of the assembly, he shall tender the resignation of the state exco. Now, since the MB has not tendered his resignation to the ruler yet, the exco remain intact and functioning,” Surendran said further.
He said that the sacking of Abdul Khalid as MB only affects him personally and makes it “untenable” to continue remaining as MB.
“Thus the sacking of MB by his party in no way deprives the exco of executive authority or lay any obligation upon them to resign,” he said.
Surendran reminded that while the exco members are appointed by the Selangor ruler under the advise of Abdul Khalid, they were nominated by the respective Pakatan Rakyat component parties.
“Most importantly, it must be understood clearly there is no constitutional or administrative crisis in Selangor as claimed by some quarters. The BN has many times changed MB without any suggestion of a constitutional crisis,” he said.
He said that Pakatan has the “legal, moral and constitutional authority” to continue to form the state government since it has a two-thirds majority in the House.
