MIC gets stay on ROS re-election order

MIC president G Palanivel and four other party leaders today obtained a court order to stay the Registrar of Societies (RoS) directive for the party to hold fresh elections. 

High Court (Appellate and Special Powers Division) Judge Asmabi Mohamad allowed the application by the five MIC office-bearers to stay the RoS directive pending the disposal of the judicial review hearing.

Senior federal counsel Amarjeet Singh, who represented the RoS, told the media that the court had set May 27 to hear the judicial review applications.

Two applications for leave for a judicial review had been filed separately.

The first application was filed on Feb 23 by MIC Central Working Committee (CWC) member A K Ramalingam, 47, who named RoS and its director-general, Mohammad Razin Abdullah, as the respondents while the second application was filed on Feb 24 by Palanivel, MIC vice-presidents S Sothinathan and S Balakrishnan and former MIC secretary-general A Prakash Rao, naming the RoSand the minister of home affairs as the first and second respondents, respectively.

In their application, Palanivel, Sothinathan, Balakrishnan and Prakash Rao sought, among others, a declaration that matters associated with the party elections were subject to the party's constitution and could not be based on views of the RoS.

They also sought a declaration that the outcome of the MIC annual general assembly held on Nov 30, 2013, was valid and enforceable.

The four leaders also sought an injunction to prevent the two respondents from taking any action or issuing any directive against the MIC until the judicial review has been disposed of.

They had obtained leave on March 20 for a judicial review from the High Court to challenge the RoS decision.
