Aug 27 set for Federal Court verdict in Khir’s appeal
The Federal Court is to deliver on Aug 27 its decision in the appeal by former Selangor menteri besar Dr Mohamad Khir Toyo against his conviction and 12-month jail sentence for allegedly using his position to obtain land and a bungalow unit.
Federal Court corporate communications and international relations head Mohd Aizuddin Zolkeply today informed the media of the decision date.
The five-member Federal Court panel chaired by Chief Judge of Malaya Zulkefli Ahmad Makinudin had reserved judgment on Khir’s appeal after hearing the matter on Jan 19.
The other judges were Ahmad Maarop, Hasan Lah, Jeffrey Tan Kok Wha and Ramly Ali.
On Dec 23, 2011, the High Court in Shah Alam found Dr Khir, 49, guilty of obtaining for himself and his wife Zahrah Kechik, 47, two plots of land and a bungalow at Section 7, Shah Alam, in 2007 from Ditamas Sdn Bhd through its director Shamsuddin Hayroni, and had sentenced him to 12 months jail.
The former Sungai Panjang assemblyperson was accused of committing the offence at the official residence of the Selangor Menteri Besar at Jalan Permata 7/1, Section 7, Shah Alam, on May 29, 2007.
The High Court also ordered that the properties involved be forfeited and handed over to the government.
On May 30, last year the Court of Appeal dismissed his appeal and upheld the High Court’s decision. Dr Khir subsequently filed his appeal to the Federal Court.
Dr Khir is represented by a team of lawyers led by senior lawyer Muhammad Shafee Abdullah while deputy public prosecutor Mohd Masri Daud appeared for the prosecution.
