The Kuala Lumpur High Court has fixed Oct 13 to hear the Home Ministry's stay application on the court's decision to quash the suspension of The Edge over articles related to 1MDB.

Justice Asmabi Mohamad fixed the date in chambers after meeting with counsels Darryl Goon and Raja Elaine Soraya Raja Aman who are representing The Edge , and senior federal counsel Suzana Atan who appeared for the ministry and government.

That date was initially fixed for assessment of damages but the stay application would have to be heard first.

Suzana said the stay is sought because if the Court of Appeal allows the ministry's appeal, it would negate the effects of the decision.

The Edge Financial Daily and The Edge Financial Weekly have been suspended by the ministry for three months beginning July 27.

However, following the High Court's decision last week, both papers had resumed publication.

Justice Asmabi in her decision to quash the suspension ruled that the ministry's decision to bar the publications was full of illegality and irrationality, and breached the rules of natural justice.

The judge said the Home Ministry did not furnish particulars to The Edge on which articles they were referring to in the show-cause letter, with the publication given seven days to reply.

Since the particulars were not clear, Justice Asmabi said it was difficult for the applicants to respond to the show-cause letter which was given by the ministry sometime in late June or early July.

"Hence, the decision to suspend could be seen as violating the rules of natural justice," she said, adding that the daily had published 300 articles on 1MDB since 2009.
