PAS president Abdul Hadi Awang has yet to decide whether he would file a fresh private member’s bill on hudud in Parliament.

Lawyer Takiyuddin Hassan, who is also PAS secretary-general, said this when asked by the press today whether his client planned to file a fresh motion on the matter in Parliament.

“Not that I know of. As his lawyer, I have no idea. As the party secretary-general, not at the moment.

“We haven't decided whether to file a new motion or not. As far as I know, there is no intention at the moment,” he said at the High Court today.

However, he said there was no injunction from the court preventing Hadi from doing so.

“There is no injunction from the court if PAS wants to file in the motion. But whether to do it or not, you have to ask the PAS president,” he said.

Justice Asmabi Mohamad today fixed Nov 9 for the decision on Hadi's application to strike out the case against the challenge to his private member’s bill to amend the Syariah Courts (Criminal Jurisdiction) Act 1965.

The amendment is to pave the way for hudud implemention in Kelantan.

Hadi, who is Marang MP, in his objection argued that the application made by Mansoor Saat, Azira Aziz, Hasbeemaputra Abu Bakar and Hazwany Jamaluddin should be raised by way of judicial review and not by an originating summons.

Injunction sought

Mansoor, Azira, Hasbeemaputra and Hazwany also named Parliament speaker Pandikar Amin Mulia, deputy speakers Ismail Mohamed Said and Ronald Kiandee and Parliament secretary Rosmee Hamzah as defendants.

They want to challenge Hadi's private member's bill for the hudud law, seeking a declaration that it is unconstitutional.

They are also seeking seek an injunction to stop the Dewan Rakyat from debating the private member’s bill.

Takiyuddin today, however, said the injunction depended on the outcome of Hadi’s striking out application.

“If our application to strike out their application is allowed, (there is) no need (for an) injunction,” he said.
