Nov 4 for case management of suit over Aminulrasyid’s death

The High Court in Shah Alam has fixed Nov 4 for case management of the lawsuit against police and the government by the family of teenager Aminulrasyid Amzah, who was shot dead about five years ago.

Justice Ahmad Zaidi Ibrahim set the date when the case was brought for mention in chambers today.

Counsel Zulkifly Omar, who is representing corporal Jenain Subi, the policeman who fired the fatal shot, said he was in the process of scrutinising witnesses’ statements.

The lawyer said he was also waiting for further instructions to file his written submission on the case.

Aminulrasyid’s mother, Norsiah Mohammad, 66, and his eldest sister, Nor Azura Amzah, 45, named Jenain; former Selangor police chief Khalid Abu Bakar (now inspector-general of police); the Shah Alam district police chief; the inspector-general of police; and Malaysian government as defendants.

The plaintiffs are seeking damages of almost RM50 million for Aminulrasyid’s death from a fatal gunshot wound to the head, which they alleged was due to Jenain’s negligence.

In November 2013, the Court of Appeal affirmed the High Court’s decision to acquit Jenain of a charge of causing Aminulrasyid’s death during a car chase at Jalan Tarian 11/2, Seksyen 11 in Shah Alam, between 1.10am and 2am on April 26, 2010.

In acquitting Jenain in 2012, the High Court held that the policeman did not intend to cause Aminulrasyid’s death and had fired at the vehicle driven by the teenager to force him to stop.
