EAIC welcomes prosecution of three cops for custodial death

The Enforcement Agencies Integrity Commission (EAIC) today welcomed the move by Attorney-General's Chambers to prosecute three police personnel involved in the custodial death of Syed Mohd Azlan Syed Mohamed Nur at a lock-up near Kota Tinggi two years ago.

EAIC chairperson Yaacob Md Sam said they were charged under Section 304(b) for culpable homicide not amounting to murder at the Kota Tinggi Sessions Court.

If convicted, the police personnel face a maximum jail term of 10 years or fine or both.

“The EAIC had recommended that the police officers be prosecuted as they were found to be involved in criminal wrongdoing which was identified in our investigation report.

“We also welcome the police disciplinary board taking disciplinary action on those identified in the EAIC report,” said Yaacob in a statement today.

The EAIC in its investigations found Syed Mohd Azlan (photo) was "murdered" by police personnel, who beat him up in the police station lock-up in Sungai Rengit, Johor, on Nov 3, 2014.

He suffered 61 injuries to his face, body and legs, some of which were consistent with "defensive wounds while protecting himself from physical attack by police personnel", the EAIC found.

The commission also found evidence that police personnel cleaned the scene of the beatings before the medical officers arrived to check on Syed Mohd Azlan.

The police also disposed the rubber mat and carpet believed to have been stained with the blood of the deceased.

Syed Mohd Azlan, a welder, was arrested on Nov 3, 2014, after a police report was lodged over a brawl involving a firearm in September that year.

He was arrested by 13 police personnel, who ambushed the room he rented in Pengerang, Johor, the EAIC said.

Syed Mohd Azlan was then taken to the Sungai Rengit police station and questioned on the brawl and if he had kept firearms. No firearm was found in a police search at his family home.

He was then taken to the Kota Tinggi police district headquarters for the remand procedure, but was noticeably weak and unresponsive on the way there.

Personnel escorting him then rushed him to a nearby clinic, where he was declared dead.
