Adib inquest: Bid to include 'save temple' members, devotees fails
INQUEST | The Coroner's Court has dismissed the application for the Save Sri Maha Mariamman committee members and a number of devotees to be included as interested parties in the inquest into the death of Fire and Rescue Department personnel Muhammad Adib Mohd Kassim.
Coroner Rofiah Mohamad said there are no substantial and reasonable grounds to include them.
“As the coroner, I cannot exceed the boundaries outlined in (Section) 377 of the Criminal Procedure Code.
“The committee has no interest (in the matter), therefore the application is rejected. Similarly, the (same applies to the) devotees whose identities are unknown,” she added.
Lawyer Siti Zabedah Kassim is representing the devotees, whereas M Visvanathan is acting for the Save Sri Maha Mariamman committee members.
Both parties have agreed to file an application for a judicial review with the High Court tomorrow.
Previously, the court ruled that the lawyer representing Adib's family is an interested party in the inquest and could pose questions to witnesses.
Earlier, Rofiah allowed a lawyer for Suhakam, Mansor Saat, to hold a watching brief during the inquest proceedings.
The inquest, which is to determine Adib's cause of death, would start on Feb 11 and end on April 12.
Last December, Adib had succumbed to his injuries sustained during a riot outside the temple located in Subang Jaya, and the authorities claimed that he was assaulted.
If they are not interested parties, why do they want to be represented in the inquest? Why after being rejected, they still persist to file appeal to the High Court?
Who are these authorities? It's not true to say the fireman was injured during violence (alleged) at the temple or that he sucuumbed to the injuries. He had reportedly no injuries anywhere. The Inquest is to facilitate the issuance of the death certificate. The death certificate must state cause of death. The cause will be a medical and scientific one. At present, no death certificate has been issued despite the post-mortem. Another is underway. The facts show the fireman had six crushed ribs. After he died, it was discovered he had undetected fractures below. Apparently, there were no injuries on the fireman. The media should not mislead the people.
Flawed! The Temple should be represented as it happened on the temple premises!
