NUBE accepts mediation in HSBC case
National Union of Bank Employees (Nube) Malaysia has accepted the mediation offered by the United Kingdom National Contact Point (UK NCP) in its dispute with the Hong Kong and Shanghai Banking Corporation (HSBC)

National Union of Bank Employees (Nube) Malaysia has accepted the mediation offered by the United Kingdom National Contact Point (UK NCP) in its dispute with the Hong Kong and Shanghai Banking Corporation (HSBC)
According to Nube president J Solomon (above), the UK NCP had made the offer to both the Nube and HSBC Bank Malaysia Bhd within the process of the national contact point on Sept 21, 2021.
“The UK NCP said it had decided to accept some of the complaints lodged by Nube and UNI Global Union about HSBC Bank Malaysia Bhd as valid, and the complaint will go forward for mediation,” said Solomon in a statement today.
In February, Nube lodged a complaint to the International Labour Organisation (ILO) over the alleged violation of trade unions and workers’ rights in the country.
The allegations investigated by ILO are the Human Resources Ministry’s alleged failure to:
Enforce a collective agreement signed between Nube and HSBC;
Allow union members to be able to carry out demonstrations and picketing in furtherance of the dispute;
To stop harassment, intimidation and termination of union members by HSBC;
To protect the rights of Nube to carry out negotiations and collective bargaining with HSBC;
To stop HSBC from carrying out outsourcing and other activities in complete disregard to the collective agreement signed, which obliged HSBC to negotiate with Nube before taking any such action;
To initiate dispute settlement and the refusal by the Industrial Court to recognise an agreement signed between Nube and HSBC
Prior to the ILO complaint, Nube had allegedly been appealing to Human Resources Minister M Saravanan since Nov 12, 2020, to intervene in the matter.
The union said that mediation within this process would be provided by an external mediator commissioned by the UK NCP.
Solomon said that Nube had accepted the mediation to resolve the issue in the best interest of its members.
“The objective of this mediation is to resolve the complaint through mutual agreement and discussion between the parties,” said Solomon.
He also reiterated that Nube was committed to protecting the rights and welfare of workers in the Malaysian banking industry.
