A Special Branch (SB) officer has filed two civil actions over the allegation that he was involved in 212,169,722.40 rupiah (RM63,682.91 exchange rate as of May 31) false claims case in Pontianak, Indonesia.
ASP Muhamad Azwan Jamaldin initiated the lawsuits against former senior Bukit Aman management director Ramli Din and ex-diplomat Mohiuddin Ghazali.
The civil suits against Mohiuddin and Ramli were filed at the Kuala Lumpur Sessions Court on April 6 and May 25.
The government is also a defendant in both suits.
Mohiuddin was Malaysia’s former consul in Pontianak, and Azwan used to be attached to the consular office there.
According to copies of the statement of claim, Azwan is suing over emails and letters sent out over an internal investigation against him regarding the false claims case that purportedly happened on Feb 24, last year.
The plaintiff claimed that he was defamed by words contained in emails sent out by Mohiuddin dated Dec 23, 2020, Feb 19, 2021, and March 8, 2021.
Azwan alleged that the former diplomat wrote that the consul’s internal investigation showed the claims made were false and that it was proposed that an investigation committee be set up to further probe the matter.
The plaintiff claimed that Ramli defamed him via a letter dated March 23 last year in regard to the internal investigation against him.
Azwan alleged that the email stated that Ramli received an email from the Malaysian consul in Pontianak regarding the internal investigation.
He further alleged that the emails and letters - which were further circulated to several other people - had painted him as a person who was involved in swindling government funds, among others.
When contacted, the plaintiff’s counsel M Manoharan confirmed the filing of the two civil actions.
The lawyer added that the suits against Mohiuddin and Ramli have been set for further case management before the lower civil courts on June 3 and 15 respectively.
