He said Fahmi is being investigated under three legal provisions: Section 4(1) of the Sedition Act 1948, Section 233 of the Communications and Multimedia Act for misuse of network facilities, and Section 504 of the Penal Code for intentional insult intended to provoke a breach of peace.
The caricature in question depicts Musa, wearing his ceremonial headgear as Sabah’s governor, with an RM100 note in his mouth. An earlier version of the caricature included the phrase “Sabah’s Number One Corruptor” in Malay.
Musa, who was appointed as Sabah’s governor on Dec 17 and will assume office tomorrow, previously faced 46 charges of corruption and money laundering but was acquitted.
According to Fahmi’s social media posts, he displayed the poster on a wall in Asia City, Kota Kinabalu, on Dec 27, but it was removed just hours later.
Various groups and individuals have condemned Fahmi’s arrest, calling for his immediate release and criticising the legal actions against him as an attack on freedom of expression.
Bernama reported that Fahmi's lawyers Nurul Rafeeqa Afdul Mutolip and Sherzali Herza Asli confirmed his client has been remanded until tomorrow.
Magistrate Wan Farrah Farriza Wan Ghazali issued the remand order at the Kota Kinabalu Magistrate’s Court today.
