PKR de facto leader Anwar Ibrahim will let the police have his DNA sample if the court orders for it, said his legal counsel Sankara Nair today.

anwar arrest sankara nair pc 160708 01 Speaking to reporters at the politician’s residence in Bukit Segambut, Kuala Lumpur, Sankara said the police can apply to the court if they needed the sample.

During his overnight detention yesterday, Anwar refused to provide his blood sample to the police when they took him to the Kuala Lumpur Hospital.

However, Sankara noted that the police’s move could be frustrated by a legal precedence.

"There is a case law - a case presided by then high court judge KC Vohrah - which disallowed the police to compel anyone to give blood or bodily samples," he said.

According to Deputy Inspector-General of Police Ismail Omar, the police are presently exploring legal avenues to acquire Anwar’s DNA.

On June 28, Anwar's former aide Saiful Bukhary Azlan stunned the nation when he lodged a police report alleging that he had been sodomised by the former deputy premier.

'Manipulation of police report'

In a related matter, Sankara revealed that he had made five attempts - verbally and in writing - to obtain the police report lodged by Saiful.

"The police report is a public document and the accused should be given a copy," he said.

PKR supreme council member and lawyer Latheefa Koya explained that normally, the police would withhold reports to protect the identity of the accuser but in this case, Saiful is already known to the public.

"Our concern is that the police report may be subject to manipulation after the police obtain statements from Anwar," she said.

Earlier, Sankara said Anwar refused the investigating officer’s request to hand over his passport as the opposition leader had yet to be charged in court.

He said no restriction of movement had been placed on Anwar and he would be reporting back to the Kuala Lumpur police headquarters as planned on Aug 18.

"By then, they can choose to extend the police bail period, decide there is no need for further investigation or charge him," he added.

Anwar was arrested yesterday to assist police in the investigation of Saiful’s allegations. He was released at 9.45am this morning.
