The prosecution is building its case, with witnesses testifying that the mineral water bottle, toothbrush and towel, from which the 'Male Y' DNA samples were taken, were obtained from a cell occupied by Anwar Ibrahim on the night of July 16, 2008.

azlan The prosecution reveals that the items, which were positively identified by chemist Nor Aidora Saedon to contain the DNA sample of 'Male Y', were derived from a cell in the Serious Crimes division of the Kuala Lumpur police headquarters, where Anwar was held that night.

The prosecution has so far not made any direct link between Anwar and the DNA sample.

Its most direct link between Anwar and its case against him till now has been the CCTV recording to indicate what appeared to be the PKR de facto leader arriving and exiting the Desa Damansara condominium on June 26, 2008.

Images of what appeared to be complainant Mohd Saiful Bukhari Azlan were also seen.

The defence has yet to finish cross-examining ASP Fauziah Che Mat, who explained to court she was asked to identify and print images of seven people, whom she did not name.

8.40am: Reporters and an embassy official from Netherlands are still awaiting the opening of the courtroom at the Jalan Duta court complex in Kuala Lumpur.

Opposition Leader Anwar Ibrahim and his lawyers are yet to arrive.

8.45am: Anwar arrives with his wife, Dr Wan Azizah Wan Ismail, and several supporters.

8.56am: Anwar is having a discussion with his defence team comprising Karpal Singh, Param Cumaraswamy, CV Prabhakaran and Sankara Nair outside the courtroom.

9.02am: Karpal and his defence team, along with solicitor-general II Mohd Yusof Zainal Abiden, meet judge Mohamad Zabidin Mohd Diah in his chambers.

9.15am: Court begins hearing with Justice Mohamad Zabidin presiding.

L/Cpl Mohd Hazri Hassan, 32, a police photographer, is the 14th prosecution witness.

9.18am: Lembah Pantai MP Nurul Izzah Anwar enters and takes a seat in the public gallery.

Hazri says at 11am on July 17, 2008, he was on duty at the KL police contingent headquarters lock-up.

"I was asked to take photos of the D9 lock-up there by Supt Amidon Anan.

"I took 14 photos of the lock-up," he said, adding D9 is the Serious Crimes division lock-up.

9.23am: The photographs and negatives are tendered as evidence.

9.24am: Hazri says there was a mineral water bottle in the lock-up.

"I also took a photo of a strand of hair. I also took photos of a toothbrush and towel," he said, adding the photographs were taken according to the original position the items were found.

9.27am: The witness says he wore special clothing in the lock-up and he did not touch the items he photographed.

The prosecution finishes its examination-in-chief. Karpal says no cross-examination.

9.28am: Former Supt Amidon Anan takes the stand as the 15th prosecution witness.

Amidon, 60, testifies while standing. He retired in August 2008, and had been head of the Crime Scene Investigation (CSI) unit at the federal police headquarters in Bukit Aman from 2005.

The witness says he has testified in about 900 cases. 

NONE 9.33am: Amidon says on June 30, 2008, while he was working, DSP Jude Blacious Pereira ( left )  asked for his assistance.

"He wanted me to analyse the crime scene at a condo in Damansara - Units 11-5-1 and 11-5-2 of the condo."

"We arrived at the condo at 12.20pm and did forensic investigation at both units."

Amidon, in looking at his document, says he retrieved a strand of hair from at a room at the end of unit 11-5-1.

"In the other unit, we retrieved a Chinese silk carpet and a blanket Duvan."

9.39am: Amidon says he gave the sealed items to DSP Pereira.

A document indicating the handover of exhibits, which included the signatures of Amidon and Pereira is tendered as evidence.

9.43am: Amidon identifies the strand of hair found at the 11-5-1 condo along with the carpet and Duvan blanket retrieved from the other unit.

He testifies he and his team wore special clothing as well as gloves in order to prevent the evidence from being contaminated.

9.46am: Amidon says on July 17, at about 11.40am, he was directed by KL Criminal Investigation Department (CID) chief Ku Chin Wah to retrieve items from the IPK KL lock-up.

9.48am: Amidon says at D9, there is one lock-up and one cell.

"It was locked and guarded by two policemen. When I arrived constable Adnan Safril opened the lock-up. I went into the cell which was also locked."

Amidon said he observed the area he found a strand of hair, a Cactus mineral water bottle, toothbrush, and a 'Good Morning' towel.

9.55am: Amidon says he tagged those items and called in the photographer.

9.58am: The witness identifies the items from the photographs.

10.02am: Amidon says he signed on the towel, mineral water bottle and marked the toothbrush, and packed the items (the strand of hair, mineral water bottle, toothbrush and towel) in separate envelopes.

10.10am: Amidon verifies the items which he had marked from the KL IPK lock-up.

"Inilah bulu yang saya rampas. (This is the strand of hair which I seized.)," he says.

Karpal objects to the item being marked as exhibit and requests for a "trial within trial".

Judge asks for the basis of Karpal's request. He rules the court will mark the strand of hair as ID57 (identification).

10.15am: Amidon identifies the toothbrush, and the 'Good Morning' towel.

These items are marked as exhibits ID58 (toothbrush) and ID59 (towel).

Amidon verifies the items based on the envelope which they were stored and the signature which he had made on the items.

10.17am: Amidon also testifies the mineral water bottle was the one which he retrieved from the lock-up. Item is marked ID61.

(There was another strand of hair found on the towel by chemist Nor Aidora, which the CSI did not mark, and hence the hair is marked ID60.)

He says he wore the same protective gear and gloves when in the lock-up.

Prosecution finishes its questioning of Amidon. No cross-examination from the defence.

10.20am: Chief inspector Nor Ayuni Mohd Fuad, the 16th prosecution witness, called into the courtroom to take the stand.

10.24am: Nor Ayuni is one of four officers assisting Amidon.

10.26am: Anwar is seen reading a book in the dock, while the witness is testifying.

10.30am: Nor Ayuni, 28, identifies her writing on the envelopes used to place the items seized in the lock-up.

She says she wore protective clothing, boots and gloves to prevent contamination of the samples.

"All of us wear similar clothing," she says, adding they finished their tasks at 12.20pm.

No cross-examination, says Karpal. Nor Ayuni released.

10.34am: Court adjourns for short break. Hearing to continuing at 11am.

11.09am: Court resumes. Selangor government information chief  Badrul Amin arrives.

NONE The 17th witness, DSP Yahya Abdul Rahman ( right ), is called to testify.

He says he has served in D9 at IPK KL since 2006 until now.

Yahya said the D9 lock-up is located on the seventh floor with one cell.

11.13am:

Witness says there is a 'Buku Lawatan' (Visitors’ book) lock-up there. DPP Nordin asks to look at ‘Entry 191', which Yahya had written.

Yahya says that on July 17, 2008, at 12.10am, the lock-up detainee was Anwar Ibrahim.

11.16am: Karpal objects, saying the defence has not been provided with the document.

Judge says he wants the parties to sort it out.

DPP Nordin asks witness if he had visited the lock-up, asking further: Who was at the lock-up?

Yahya : ‘It’s Datuk Seri Anwar Ibrahim.’

Witness says he was there to ensure Anwar is treated well.

11.19am: Witness says at the time, there was one ‘Koperal Bala’ and ‘L Coperal Yusmadi’ at the premises.

He says he handed Yusmadi a package containing a towel, toothbrush and toothpaste.

"It is government issue for detainees," he said.

11.21am: Kelana Jaya MP Loh Gwo Burne makes his way into court. Witness says Anwar was alone, as there were no other detainees.

Yahya also says there was a 'Buku Keahlian' lock-up. It is marked as exhibit P82. Noordin points to the book, which has Sankara's signature.

Sankara is seen consulting with Anwar.

NONE 11.28am: Witness says he was at the scene when Anwar was brought to the lock-up.

"DSP Jude was also there," he says.

Asked by DPP Noordin whether he knew where Anwar was coming from, the witness says Anwar came from the D9 meeting room.

"Jude and I accompanied Anwar."

Noordin: Did Anwar carry anything?

Yahya: The mineral water bottle.

Noordin: Who allowed Anwar to bring the mineral water bottle?

Yahya: I allowed it.

Noordin: Is the mineral water government-issued?

Yahya: No.

11.32am: Witness says Anwar was released at 8am on July 17.

"There was no "tangan lain" (other hand) in the lock-up. I directed two of my men to lock the cell and lock-up."

11.36am: Witness says he saw from outside the mineral water bottle, toothbrush and towel in the cell.

"I look it from outside the lock-up," says Yahya.

11.40am: Prior to Anwar's release, Yahya says he greeted Anwar "Selamat pagi, Datuk Seri".

Yahya says he retrieve (an extract of the Quran called) Surah Yasin from Anwar.

11.43am: Witness says he retrieved two towels which were not government issued from the cell.

Noordin: Was there CCTV?

Yahya: Yes, but it was not operational. Sudah lama tak berfungsi semenjak saya masuk . (It's been non-functioning since I came).

Noordin: What were government issued?

Yahya: The towel and toothbrush.

Noordin finishes examination-in-chief.

11.46am: Karpal cross-examining now.

NONE 11.47am: Karpal says the lock-up is like keadaan binatang (for animals).

Karpal: Tandas tak memuaskan . (The toilet is unsatisfactory)

Witness: Ya .

Karpal: CCTV not operational?

Witness: We have asked for an allocation, but nothing been done (about it).

11.51am: Karpal asks who directed him to detain Anwar.

Yahya says he was asked by his superior.

Karpal: Kenapa Anwar tak dibekalkan katil dan bantal ? (Why was Anwar not given a bed and pillow?)

Yahya: Itu standard .

Karpal: Ada bekal blanket ? (Was a blanket given?)

Yahya: Tak ada .

11.54am: Karpal: A detainee does not have human rights? It's basic isn't it?

Witness: No lock-up supplies pillows.

11.56am: Noordin now re-examines: Pillow and bed are not provided?

Noordin: Is it clean after a person has left?

Witness: Ya, dicuci . (It is cleaned)

Karpal asks question through court: Is the toilet clean?

Witness: Nampak kurang bersih (It looks slightly unclean).

Witness is released.

11.59am: Court adjourns as DPP Noordin informs court that he has four witnesses.

Karpal informs the court he has a decision at High Court RKK 1 (Karpal vs Chief Justice case).

Justice Zabidin allows the court to resume at 2.45pm.

2.30pm: PKR information chief Mohd Nor Manuty is present.

Anwar arrives with Wan Azizah. Waiting for Karpal.

2.53pm: Karpal arrives in court.

2.58pm: Nik Yusmadi Nik Ismail, the prosecution's 18th witness, is called to the stand.

He is shown the lock-up visitors' book.

"I entered the entry and was working on the night of July 16."

3.02pm: Yusmadi says he wrote an entry that at 11.05pm on July 16, an OKT ( Orang Kena Tuduh , the accused) was brought in. The person is "Datuk Seri Anwar Ibrahim".

The witness says prior to that, the cell was empty.

3.11pm: Lans Corporal Mohd Azri Mohd Taib is called in as the 19th prosecution witness.

3.09pm: There is a light moment when Yusmadi is asked to identify Anwar in court.

He looks high and low, getting up to stand at the witness stand, before looking at Anwar sitting in the dock and smiles.

There is laughter in the public gallery.

3.13pm: Mohd Azri says he was working at 1.30am on July 17, 2008, and verifies that Anwar was the only detainee.

He says he worked until 7.30am.

"Chief inspector Zulkifli Fajar came to inspect the cell at 7.25am.

"There was no other detainee," says Mohd Azri.

Karpal tells the court he has no questions for cross-examination.

3.17pm: 20th witness Lance Corporal Mohd Jasni Jaafar is called in.

He is stationed at the police' traffic department.

3.20pm: Mohd Azri says he was working on July 17 when Anwar was in the lock-up.

One officer came ACP Razali came with another ASP, asking Anwar about breakfast, says Mohd Azri.

"Anwar went to the toilet and I heard him brushing his teeth."

Witness says Anwar was removed from the cell at 8.10am.

"The lock-up cell was locked, and no one entered after that."

3.27pm: The witness says he entered a note in his pocket diary that he found a bath towel, small towel, soap and toothbrush in the cell belonging to Anwar.

The pocket diary tendered as evidence.

3.34pm: Mohd Azri is released from the stand.

Constable Adnan Safri Basri called in as 21st witness.

He shouts when taking his oath, causing many in the public gallery to laugh.

3.39pm: Adnan testifies that on July 17, 2008, he finished working 1pm. He tells the court he did not enter the cell or touch any of the items in the cell.

3.40pm: Amidon is recalled.

3.42pm: Amidon is called in to verify the toothbrush, towel and mineral water bottle, the prosecution wanting to admit it as exhibit.

Karpal objects to the admission of the items as evidence.

3.46pm: Karpal wants to exclude those items as evidence and has called for a trial within trial, claiming that the police had used unfair methods to retrieve the items.

"Anwar is willing to testify on this."

3.48pm: Judge says, ‘We will continue tomorrow to hear submission.’

The submission on the trial-within-a-trial will be heard at 2.30pm tomorrow.
