The Shah Alam High Court today acquitted and discharged Ditamas Sdn Bhd director Shamsuddin Hayroni on a charge of abetting former Selangor menteri besar Dr Mohd Khir Toyo in a land deal.

Judge Mohtarudin Baki made his ruling after deputy public prosecutor Abdul Wahab Mohamad withdrew the charge.

Abdul Wahab however told the court that the charge against Khir would continue.

NONE Khir is accused of acquiring for himself and his wife Zahrah Kechik, 45, two plots of land and a bungalow in Shah Alam from Ditamas Sdn Bhd through Shamsuddin (right) .

He is said to have paid RM3.5 million for the property in Section 7 here which Ditamas had bought on Dec 23 2004 for RM6.5 million.

Khir is said to have committed the offence at the official residence of the menteri besar in Jalan Permata, Shah Alam on May 29 2007.

Shamsuddin was alleged to have abetted him.

Khir, who was menteri besar from August 2000 to February 2008, is charged under Section 165 of the Penal Code which carries a jail term of up to two years and a fine.

At today's proceeding, Mohtarudin allowed an application from Khir's counsel M Athimulan for hearing to be postponed to Wednesday to enable him to obtain important documents from the prosecution.
