PARLIAMENT PKR’s Padang Serai MP N Surendran has filed a motion to challenge deputy speaker Ismail Mohamed Said’s decision not to allow any MPs in the lower house to discuss the issue of death in custody victim A Kugan.

Ismail ruled on Monday that talking about Kugan would be sub judice because the government can still appeal the High Court’s decision on June 26 in favour of the late Kugan’s family against the government and police.

NONE However, Surendran ( right ) has sought to challenge the decision under Standing Order 43, asking the House to “reconsider the deputy speaker’s decision”.

Surendran's fellow PKR colleague R Sivarasa said that the deputy speaker's ruling was a "wrong application of the sub judice rule".

"The issue is to be only being discussed in the House, it is nonsensical to assume that the judges of the Court of Appeal could be swayed by what we say in this House," he said.

"He (Surendran) was only raising a question so that the minister can answer," he added.

PKR vice-president Tian Chua had also criticised the deputy speaker's decision, saying that the speaker had "no knowledge" if an appeal was going to be lodged when he made the ruling.
