Lawyer Hazman Ahmad for Chief Inspector Azilah Hadri said he was thankful that the appellate court had heard the inconsistencies in the prosecution’s case in allowing his client’s acquittal.

He said we have brought this to the attention of the trial judge but he had ignored it.

“We are thankful that the Court of Appeal has heard our argument on the inconsistencies in the call logs and the police station diary and the police witnesses’ testimonies in alleging that my client was present at the scene of the crime,” he said.

Lawyer Kamarul Hisham Kamaruddin for Sirul Azhar Umar said the court had accepted the defence contention on all counts raised before the court.

“These include that the slippers allegedly bearing the blood of the victim found in the car had no material link with the case.

“Most importantly, the judge has also accepted that the non-calling of DSP Musa Safri (Najib Abdul Razak’s aide de camp) was a material non-calling and has left a gap in the prosecution’s case.

“From the prosecution’s records, Musa was central to the role and could have helped explain a lot of things like motive and other things.”

NONE The non-calling of Musa, he said, amounted to the non-calling of a material witness in the prosecution’s case.

Kamarul Hisham ( right ) said this resulted in the court setting aside the conviction on his client.

He added that he would not want to say anything much, since there is a possibility of the prosecution appealing in the matter.

“Nevertheless, we are satisfied with the outcome today,” he said.

Deputy solicitor-general II Tun Abdul Majid Tun Hamzah had indicated they will appeal today’s decision.
