PKR Youth Chief Nik Nazmi Nik Ahmad has been detained by police, according to a tweet by his lawyer.

"Just met ASP Sabri who informed us that they will be detaining Nik Nazmi today," his lawyer Melissa Sasidaran tweeted.

Nik Nazmi had turned up to the Dang Wangi police station at 10am today, to give his statement regarding yesterday's Kita Lawan rally in downtown Kuala Lumpur.

The Seri Setia assemblyperson then tweeted that he was detained under the Peaceful Assembly Act and Section 143 of the Penal Code.

He has been brought to the Jinjang police station, where he will be kept overnight.

Nik Nazmi ( left ) will only be remanded tomorrow morning, as police have not yet completed their paperwork, Sasidaran told reporters after the arrest.

She also pointed out some irregularities regarding the way police are handling the matter.

This includes detaining the PKR Youth chief before he was questioned.

"I told the investigating officer that if he wanted to take Nik Nazmi's statement, there was still time to do so...but he said these were his orders (to detain Nik Nazmi)," she said.

It was however unclear where the orders came from.

The section of the PAA under which he was detained, has also been ruled as unconstitutional she added.

The Court of Appeal had in relation to the Black 505 rally ruled that the requirement of a formal 10 day notice before holding a protest, as stipulated under Section 9 of the PAA was unconstitutional.

Sasidaran also questioned the decision to detain him as a "repeat offender".

"He has been repeatedly charged and discharged four times, so he is not an offender, as he has never been convicted," she said.

Another oddity she pointed out, was the reason police gave him to come for questioning.

"Yesterday he was told that his statement would be taken under Section 14 (3) of the Peaceful Assembly Act 2009, which doesn't exist, there is no section 14, and the PAA is 2012, not 2009," Sasidaran told reporters after the arrest.

Meanwhile, Nik Nazmi's wife Imaan Abdul Rahim said she expected the arrest.

"It's kind of expected, this is not the first time.. It was only a matter of time before they took him. We'll just pray for the best and see what we can do for him," she said calmly.

Police slammed

10,000 protestors convereged outside Sogo Mall in the capital city yesterday to call for the release of jailed opposition leader Anwar Ibrahim.

While the rally proceeded without incident until its conclusion after the protestors marhed on to KLCC, PKR Padang Serai MP N Surendran ( left ) today slammed the police for acting against what has been peaceful assembies.

Yesterday, the police detained Kelana Jaya PKR Youth Chief Saifullah Zulkifli under Section 143 of the Penal Code to facilitate investigations.

Meanwhile Perak PAS youth treasurer Mohd Fakhrul Razi Mokhtar has also been called for questioning by Dang Wangi police at a yet to be specified time.

When contacted, he said he was not afraid of being detained, as he was only exercising his democratic right in yesterday's protest.

"I haven't done anything wrong, I was only exercising my democratic right to freedom of expression," he told Malaysiakini .
