A film producer is peeved that a video promoting how the Trans-Pacific Partnership Agreement (TPPA) will protect copyright has infringed into his own copyright.

Zarul Albakri said the offending video, posted on the 'TPPA Malaysia' Facebook page, used excerpts of his 1986 movie 'Kembara Seniman Jalanan' without his permission.

The two-minute 30-second video begins with text describing the movie, starring M Nasir and Pyanhabib, which tells of how artistes suffer when their works are "not respected, stolen, plagiarised and their copyright not protected".

The video then plays a 20-second excerpt from the film showing Bujang, a character portrayed by Nasir, storming into a press conference to punch a man who stole his song.

"Pyanhabib told me last week that an excerpt from the film was being used in a TPPA video.

"It was shocking. No one had contacted me to get permission to use it… they could have at least contacted me as a sign of respect before using the film in their campaign," Zarul ( photo ) said when contacted.

He added that he was dumbfounded and speechless over what had transpired.

The administrator of the 'TPPA Malaysia' Facebook page, when contacted, told Malaysiakini to refer to the Copyright Act section on exceptions made for the use of copyright material.

'TPPA Malaysia' also commented on the issue on Pyanhabib's Facebook page, saying that the use of copyright material for non-commercial purposes is not an offence.

"For non-commercial uses, you need to make clear that the copyright material doesn't belong to you," it said.

Section 9(4) of the Copyright Act states that published works can be used in research, private study, criticism, review or news if acknowledgement to the original work is made.

Section 9(5) pf the Act says the government can reproduce published work if it is for public interest and is of fair use.
