Sodomy II: Anwar fails to get HKL medical reports

Cala: What is there to hide? To be fair to justice Mohd Zabidin Mohd Diah, it may be premature to label him as unprofessional or partial at this early stage of the trial. But context matters.

What is disturbing to the man on the street is his view on the state of affairs on our judiciary after MM's (Mahathir Mohamad) 22 years' rule. Will an average man trust that the legal system, given as it is, able to discharge its duties as it used to be? Remember the sacking of Lord President Salleh Abas in a contentious environment?

Remember the extension of Eusoff Chin's contract after his New Zealand holiday with a lawyer (Wain, 2009, p. 347, para 4)? Remember the expunge of medical evidence relating to Sodomy 1 by the Paul Augustine court (because the evidence were all false)? Remember how VK Lingam bargained for the chief judge post in a videotape?

In sum, can a poor man on the street be blamed if he demands a more cooperative bench in Sodomy II?

Ferdtan: If the prosecutors and the judge have the real evidence, then release the Hospital Kuala Lumpur doctors' reports to the defence. What are you afraid of? The whole world knows that this court is 'monkeying' around with justice. Shame to all the 'running dogs' including the would-be tainted doctors.

I pray to Almighty that all of the guilty ones be made to pay dearly, not only in this life but in the next.

Robert L: An unbelievable judgment by the High Court which goes against all semblance of justice - to be done and to be seen to be done. This court case is a total farce. I wonder whether judge Mohd Zabidin realises how ridiculous his judgment looks to the rest of the world. I'm embarrassed to be Malaysian.

Darren: This is a classic example of a man who has not been put through the mill. If it has been a clever guy sitting there; he would have said that there is a provision or legal basis that such documents must be supplied to the defence.

The only salvation to bring back the dignity to the nation is an early election. Enough is enough!

Tan Kian Khim: Why deny the application? Mohd Zabidin clearly has no understanding of proper judicial procedure and should be immediately stripped of his position.

There is absolutely no legal basis to deny the defence access to these documents for the purpose of verification. Any proper trial with a proper judge in another country would have allowed it, but no... this is Malaysia; Malaysia under Umno-BN does not have to play by the rules.

By this blatantly partisan and unjustifiable action in blocking the defence application, Zabidin has disgraced himself and the High Court, but clearly he does not mind that his family and descendants will have to live with the after-effects of his ill-repute as a failed judge.

Edwin Selvaraj: Logically, the accused should have the right to all evidence or else how can justice be served? This does not make sense at all.

Mikey: There is no justice in Bolehland. What irks me is that countries like the United States, Singapore, United Kingdom, Australia and all those supposedly proponents of democracy and justice sit idly by. I am no great fan of Anwar Ibrahim, but I cannot help but feel angry at the injustice done to him.

Arul Inthirarajah: If anyone had any doubt left, the behaviour of both the prosecution and the judges involved in witholding evidence, can only mean one thing: that Anwar is innocent, and the entire charade is politically motivated.

Passing Cloud: I wonder what the former chief justice has to say on the latest failure of Anwar in obtaining the medical documents and samples for his defence. Abdul Hamid Mohamad is currently serving as head of the advisory board of the Malaysian Anti-Corruption Commission (MACC). He acquitted Anwar in the first sodomy trial.

Pity Him: What in the world is law and justice. It is mooted by man, manipulated by man, and defined by man sitting in the bench. However, the first reaction of a layman to this is the accused is already condemned without any ruling. It's apparent there is no fairness to the accused.

Swipenter: Every step of the way the judge and the prosecutor erect barriers for justice to be done and seen to be done. We have lost our soul and moral compass as a nation. Nothing is sacred anymore; only money and power counts.

Lover Boy: Mohd Diah, I do not know which law school you graduated from. As a lay person, if Anwar committed the sodomy, the proof will be there. What is so wrong in letting the defence to know what is in the hands of the prosecution? This trial by ambush is something that have to be stopped.

Ahmike: The burden of proof is the obligation to shift the accepted conclusion away from an oppositional opinion to one's own position. And the burden of proof may only be fulfilled by evidence.

Sarawakian: The country have a lot of kangaroos running the judiciary. Justice is already dead and buried a long time ago. Dr Mahathir Mohamad made sure of that.
