Perak Pakatan Rakyat is to lodge a police report against Menteri Besar Zambry Abd Kadir and and exco member Dr Mah Heng Soon for the distribution of 50,000 copies of the State Assembly sitting on May 7, 2009, that the state government said it distributed to Perak voters.

Zambry and Mah, Perak DAP secretary Nga Kor Ming said, must face the same music as Tebing Tinggi assemblyperson Ong Boon Piow, who was to be charged in court in yesterday for violating the Censorship Board Act, 2002, but had the matter put off by the prosecution.

NONE Ong ( left ) has been accused of committing an offence under Section 6(1) of the Act for having in his possession 23 DVDs, without the Censor Board's B certificates, at the Chin Woo Hall in Ipoh on March 29 last year during a party function, at which the DVD was screened.

The allegedly offending DVD contained footage of the March 3, 2009, emergency session of the Perak state legislative assembly, held under a tree near the state assembly building, which Ong recorded.

The charge against Ong before a magistrate's court in Ipoh was deferred yesterday for the state prosecution chief to get advice from the Attorney-General's Chambers in Putrajaya.

Ong called on the AG's Chambers to drop the charge against him, saying that if it proceeded with the case, then it should also prosecute the BN leaders Zambry and Mah.

'There should be no double standard'

Perak DAP secretary Nga Kor Ming cited Article 8 of the federal Ccnstitution, which stipulates equality before the law, and said there should not be any double standard by prosecuting Ong if Zambry and Mah are left out.

The vocal DAP leader also said that Malaysians would be keen to see whether the administration of Prime Minister Najib Abdul Razak would uphold the rule of the law by taking the two state BN leaders to court as well.

Perak police chief Zulkifli Abdullah has been quoted as saying that police would launch an investigation if Pakatan leaders lodged a report against Zambry and Mah.

Ong's lawyer Yee Seu Kai, who is also Pokok Assam assemblyperson, said: "The Film Censorship Act is silent about the ownership of films for private and domestic use, but the Copyright Act allows a person to hold any such material for private or domestic use, without the fear of prosecution.

"Section 6(1) of the Film Censorship Act 2002 should be amended to allow the public to keep such film materials for private or domestic usage, without the police or the concerned authorities causing a state of fear in the country."
