Ten rounds were released by the other police officer who had fired at the Proton Iswara driven by slain teen Aminulrasyid Amzah in April, the Shah Alam Sessions Court heard today.

According to Korporal Madie Samsudin, who was on duty at the armoury store of the Section 6 police station in the morning of April 26, Konstabel Izham Mahayaddin had returned 90 bullets in four magazines along with the Heckler and Koch MP5 submachine gun he was issued.

NONE This was the same type of firearm used by the accused Korporal Jenain Subi (left) , 48, who is attached to the police district headquarters.

"Konstabel Izham told me he had fired some shots but he didn't know how many. I emptied the magazines and counted the bullets and found there were 10 short. He was issued 100 bullets," Madie testified.

Earlier in the trial the court had been told that Jenain had fired 21 rounds from his submachine gun and that at least 24 bullets were fired at Aminulrasyid's car.

Madie also told the court that the 9mm bullet used for the submachine gun can be used for the pistol used by Korporal Azhar Hashim, who was in the patrol car with Izham.

However, he testified that Azhar returned all the 30 bullets that he was supplied with.

To a question from defence counsel Salim Bashir, Madie agreed that the condition in which the magazines and bullets were presented in court were different from how he had kept them, indicating that they have been “disturbed” ( diusik ).

He had emptied all the magazines and kept the bullets in a separate container, but in court three full magazines were presented with 30 bullets each, while another was presented empty.

Konstabel Ruzaimie Haili, who is the only other person who has access to the armoury store, later testified that the magazines were empty when he handed them over to investigating officer ASP Mohd Fauzi Mohamed Zin upon request, along with the HK MP5, a gun sling and magazine pouch on May 1.

He also gave ASP Mohd Fauzi the 90 9mm bullets which were all placed in a plastic bag separate from the magazines.

Jenain is charged under Section 304(a) of the Penal Code with causing the death of Aminulrasyid at Jalan Tarian 11/2 in Section 11, between 1.10am and 2am on April 26.

He faces a fine and up to 30 years imprisonment upon conviction.

The trial resumes tomorrow with the testimony of R Lokman Hakim R Daily who had chased the Iswara driven by Aminulrasyid after it had hit his friend’s car at around 12.15am on April 26.
