Judicial officers call EGM to reject Bar's motion on removing AG

The Judicial and Legal Service Officer's Association (Jalsoa) will call an extraordinary general meeting (EGM) to reject the Malaysian Bar’s annual general meeting motion to remove attorney-general (AG) Mohamed Apandi Ali.

In a statement today, Jalsoa expressed unhappiness over the Bar pressuring Apandi to resign immediately.

Jalsoa said the motion has caused dissatisfaction among the judiciary service and legal officers, who are tasked with upholding justice and protecting the sovereignty of law in the country.

It likened the Bar’s action "as though questioning the transparent legal process as stated in the Federal Constitution, which can be seen as obstructing the implementation of the AG's discretionary power".

"An EGM will therefore be called to debate the motion, among others, to reject any interference and pressure by any party, including the Malaysian Bar, in exercising its discretionary power in its administration as enshrined in the federal constitution," said the executive committee of Jalsoa.

It however, did not enclose the details of the EGM in the statement.

Jalsoa was set on Nov 28, 1964 to protect the wellbeing of the judiciary and legal officers. The association consists of some 1,000 members.

Its president, Intan Murnira Ramli, when contacted by Malaysiakini , declined to comment on the issue.

Cleared of wrongdoing

The motion to have Apandi removed was brought by Bar members Charles Hector Fernandez, Francis Pereira and R Shanmugam following Apandi's decision to clear Najib of any wrongdoing regarding the transfer of RM2.6 billion and RM42 million from SRC International Sdn Bhd to the premier's accounts.

The motion also called for solicitor-general to assume the role of public prosecutor in the case involving Najib.

Beside the March 19 AGM's motion, the Malaysian Bar is also seeking for Apandi to be disqualified from making further decisions relating to the case, requesting it be delegated to the solicitor general.

This is because Apandi had reportedly advised Najib on the cases.

Najib had claimed the money was a political donation and denied using public funds for personal gain.

The Bar is seeking a judicial review of Apandi's decision to clear Najib of any wrongdoing regarding the RM2.6 billion donation and the RM42 million from SRC transferred into his account.
