Come Monday, former opposition leader Anwar Ibrahim will know whether his application at the Federal Court – to call former Commercial Crime Investigation director Ramli Yusof to testify – will be successful.

This is part of Anwar's bid to review his conviction and five-year jail sentence for sodomy II which was affirmed by the Federal Court on Feb 13, 2015.

The application to call Ramli to testify was heard last Nov 16.

Ramli was also former CID deputy director in 1998 at the height of the sodomy I incident and was a witness in the black-eye incident.

The five-member bench led by Chief Judge of Malaya, Justice Zulkefli Ahmad Makinudin, will deliver its decision at Federal Court II. Federal Court I is currently closed and is undergoing repairs.

The other judges on the bench are Chief Judge of Sabah and Sarawak Justice Richard Malanjum, and Federal Court judges Hasan Lah, Abu Samah Nordin and Zaharah Ibrahim.

Anwar had applied to call Ramli to try and prove political conspiracy against him over the the sodomy I conviction.

The PKR de facto leader had maintained that the charges against him in sodomy II and sodomy I were politically motivated.

Ramli, who gave evidence in the suit filed by lawyer Rosli Dahlan at the High Court in Kuala Lumpur, had claimed that he was asked by former inspector-general of police, Musa Hassan (the investigating officer in sodomy I), then attorney-general the late Mohtar Abdullah and former attorney-general Abdul Gani Patail to lodge a police report that Anwar had hit himself resulting in the black eye.

However, Ramli did not lodge a police report.

"There is propensity to victimise my client, as Musa rose to become IGP in Sodomy II," Anwar's counsel and former Federal Court judge Gopal Sri Ram had submitted.

Sri Ram also told the court that Musa had bypassed Ramli, who was his superior, by consulting with Gani, along with DPP Azahar Mohamad, and Nordin Hassan despite Ramli being the Bukit Aman deputy CID deputy director.

Azahar is now a Federal Court judge while Nordin is now a Judicial Commissioner.

DPP Mohd Hanafiah Zakaria told the bench that Anwar did not pass the threshold to call Ramli as his evidence was based on hearsay evidence.

"This evidence is based on hearsay and there is no need to call Gani to make an affidavit," Hanafiah said, adding that the court had previously rejected the evidence of a statutory declaration made by former KL CID chief, Mat Zain Ibrahim, who was the investigating officer of the black-eye incident.
