The Sessions Court in Kuala Lumpur has ordered PKR secretary-general Rafizi Ramli to enter his defence on charges under the Official Secrets Act 1972 (OSA).

“It is of my view that the prosecution has managed to establish a prima facie case,” said sessions judge Zulkarnain Hassan.

Among the reasons cited were that Rafizi was proven to have possessed as well as exposed page 98 of the auditor-general’s report on 1MDB which is still classified under the OSA.

“Based on the postings on Rafizi’s website, his Facebook page as well as the Bukit Aman computer forensics unit; the court has gone through Rafizi’s website and it is clear that he had stated as well as attached the page on the 1MDB audit report that has yet to be tabled.

“There was also a press conference held on March 24 and this was recorded and the video recording was played in court,” said judge Zulkarnain.

Commenting further on the press conference, the judge said Rafizi was recorded as having admitted that the documents were "obviously under the OSA".

Judge Zulkarnain fixed Sept 27 for defence and Oct 6 and 7 for continued hearing.

Speaking to reporters later, Rafizi said he will issue a statement on the matter soon.

He is facing two charges under the OSA for disclosing the classified documents that purportedly link Lembaga Tabung Angkatan Tentera (LTAT) and 1MDB at the Parliament lobby on March 24.

The charge under Section 8(1)(c)(iii) of the Act provides a jail term of up to seven years, if found guilty.

He was also charged under Section 8(1)(c)(iv) of the same Act which provides a maximum seven-year jail term, upon conviction.
