The High Court in Kuala Lumpur today dismissed an application by the Election Commission (EC) for a stay of hearing into the merits of Lembah Pantai MP Nurul Izzah Anwar and the voters' challenge on the redelineation exercise.

Justice Azizul Azmi Adnan refused to grant the stay as there were no special circumstances to do so.

He made the decision in chambers after hearing submissions from senior federal counsel Suzana Atan from the Attorney-General's Chambers who represented the EC, and A Surendra and Aliff Benjamin representing Nurul Izzah and the voters.

As a result of this, the court fixed the hearing of Nurul Izzah and the voters' application on Feb 15.

However, this may depend on the outcome of the EC's appeal at the Court of Appeal over Justice Azizul's decision to grant leave (permission) to hear the case on its merits.

Nurul Izzah had last week questioned the haste of the appellate court to fix the EC's appeal when the record of appeal has yet to be received.

Justice Azizul granted leave to Nurul Izzah and Anwar's application on Jan 3.

Nurul Izzah had said that normally the appellate court would fix a date after two months of an appeal filed. However, in the case affecting her constituency, the AG's Chambers' appeal had been fixed on Feb 13.

"We do not know the grounds of the AG's Chambers' appeal as the record of appeal has not been filed yet. Usually this process takes two months or more.

"Yet, the Court of Appeal fixed the date to hear and expedite the request. I hope there is no interference (by the judiciary)," she said.

Nurul Izzah, 36, and 10 other registered voters in the Lembah Pantai parliamentary constituency had filed the application for the judicial review on Nov 11 last year.

In the application, they demanded a certiorari order to quash the EC's notice dated Sept 15, 2016 on the proposed redelineation exercise for federal and state constituencies.

Asked outside court Nurul Izzah said she and the voters would continue to press for the inquiry proceedings.
