Prime Minister Najib Abdul Razak and the government's application to strike out a suit filed by Petaling Jaya Utara MP Tony Pua related to the 1MDB affair has been fixed for hearing on June 15.

The decision was made after all parties met Judicial Commissioner Faizah Jamaludin in chambers today.

Najib's lawyer Nik Alia Hanafi told reporters later that her team will apply the same grounds - that Najib is not a public officer - which was used to strike out a suit filed by Dr Mahathir Mohamad and two others.

Senior federal counsel Zureen Elina Mohd Dom said the government would seek to strike out the suit on grounds that there is no reasonable cause for action.

Pua filed the suit on Jan 17, seeking a declaration that Najib had committed misfeasance in public office and that Najib had abused his office with regard to 1MDB.

He is seeking another declaration that Najib abused his public office to personally benefit from 1MDB funds.

As a taxpayer, Pua is also seeking is seeking general, aggravated and exemplary damages to be assessed by the court.

Direct role in 1MDB

In his statement of claim, the Petaling Jaya Utara MP listed Najib as a public official as he is the MP for Pekan, the prime minister and chairperson of the 1MDB board of advisers.

Pua claimed that as the PM, finance minister and chairperson of the 1MDB board of advisers, Najib had a direct role in 1MDB in approving appointments and removals in the company.

He further claimed that Najib had recklessly used his influence and position to procure guarantees for 1MDB bonds and that he had maliciously approved deals by companies associated with 1MDB.

Pua also alleged that Najib had led the unlawful misappropriation of funds in 1MDB and had been providing misleading replies in Parliament about 1MDB.

As a taxpayer, the lawmaker added, he feared the tax monies would be used to finance various guarantees and assurances made by the government in relation to 1MDB and that Najib's conduct resulted in the devaluation of the ringgit, resulting in the loss of wealth by all Malaysians.
