Trader charged in Malaysia's first case of radio frequency jamming

A trader claimed trial in the George Town Sessions Court today to two counts of radio frequency jamming and three counts of using uncertified communications equipment.

On the first two charges, Abdul Jabbar Mohamad Sulaiman, 57, is accused of illegally using a non-standard cordless phone to disrupt radio frequency at No 5, Jalan Desiran Tanjung 5, Tanjung Tokong at noon on Feb 24, 2016.

The charges are framed under Section 238(1) of the Communications and Multimedia Act 1998 (Act 588), which carries a maximum fine of RM50,000 or imprisonment of up to one year or both, on conviction.

On the third to fifth charge, Abdul Jabbar is accused of using communications equipment, namely, a caller ID converter and two cordless phones that were not certified under the Communications and Multimedia Regulations (Technique Standards) 2000, at the same place, time and date.

The charges are framed under Regulation 16(1)(b) of the Communications and Multimedia Regulations (Technique Standards) 2000 read with Regulation 16(3) of the same Regulations and punishable under Regulation 37 of the same Regulations.

Abdul Jabbar faces a maximum RM100,000 fine or up to six months imprisonment or both, on each charge if found guilty.

Judge Norsalha Hamzah did not grant bail and fixed Jan 16 for remention.

The accused was represented by counsel S Raveentharan while deputy public prosecutor Mohd Sophian Zakaria represented the MCMC.
