Election petitions against Anifah Aman, nephew go to trial

The Federal Court in Putrajaya today has separate election petitions filed against Kimanis MP Anifah Aman and his nephew, the Sipitang MP Yamani Hafez Musa, to go on trial.
The five-member panel that made the ruling on the Kimanis election petition was led by chief judge of Sabah and Sarawak David Wong Dak Wah and comprised federal judges Alizatul Khair Osman Khairuddin, Rohana Yusuf, Tengku Maimun Tuan Mat, and P Nallini.
The panel ruled that the challenge filed by Warisan's Kimanis candidate Karim Bujang complied with the Election Petition Rules 1954, and instructed Anifah to pay RM50,000 in costs to Karim.
Karim was represented by Frederick Chang Tyn Chi and Syaiful Sufyyan Sidin, while Ansari Abdullah and Tengku Ahmad Fuad Tengku Ahmad represented Anifah.
The case mention will be heard at the Election Court in Kota Kinabalu on Wednesday.
Meanwhile, a separate Federal Court bench ordered the Sipitang election petition to be reverted to the Election Court in Kota Kinabalu for mention on Feb 25.
The five-member panel was led by Court of Appeal president Ahmad Maarof also ordered the trial to be heard by a different election judge.
Other members of the bench are chief judge of Malaya Zaharah Ibrahim, Court of Appeal judge Abang Iskandar Abang Hashim, and Federal Court judges Idrus Harun and Azhar Mohamed.
On June 18 last year, Warisan had filed election petitions to challenge the outcome of four parliamentary and four state constituencies.
The four parliamentary constituencies are Kimanis, Sipitang, Libaran, and Keningau, while the state constituencies are Sungai Sibuga, Kundasang, Sook, and Kiulu.
In November last year, the Election Court had struck out the suit by Karim after allowing Anifah's application filed on Aug 24, as it was decided that Karim had failed to comply with the Election Petition Rules on several issues.
In the 14th general election, Anifah won by a slim majority of 156 votes.
He garnered 11,942 votes, while Karim got 11,786 votes.
Meanwhile, Yamani who contested under the BN ticket had defeated Warisan’s Noor Hayati Mustapha and Harapan Rakyat’s Dayang Aezzy Liman with an 852-vote majority.
However, Yamani has since reportedly submitted an application to join Bersatu.
Yamani Hafez is Anifah Aman's nephew. Yamani is Musa Aman's son. Anifah and Musa are brothers.
