Court of Appeal reserves judgment in Ku Nan's RM2m corruption case

The Court of Appeal has reserved its judgment on former federal territories minister Tengku Adnan Tengku Mansor's appeal against his conviction, as well as the sentence of 12 months' jail and RM2 million fine in his RM2 million corruption case.
A three-member bench comprising judges Suraya Othman, Abu Bakar Jais and Ahmad Nasfy told Tengku Adnan's counsel Tan Hock Chuan and lead deputy public prosecutor Asmah Musa today that they will inform both parties on the date of the decision.
"We will inform parties as soon as possible on the date of the decision," said Suraya.
Earlier, the court heard submissions from both parties on the appeal.
Last year, the Kuala Lumpur High Court found the Putrajaya MP guilty of receiving RM2 million from businessperson Chai Kin Kong.
Subsequently, he filed a notice of appeal against his conviction and sentence.
According to the charge relevant to the verdict, Tengku Adnan, in his capacity as a public servant, namely as then federal territories minister, allegedly accepted for himself RM2 million from Chai, who is also director of Aset Kayamas Sdn Bhd, via a Hong Leong Islamic Bank cheque belonging to Aset Kayamas.
The cheque was later purportedly deposited into the CIMB Bank account of Tadmansori Holdings Sdn Bhd, in which the accused had an alleged interest when it was purported that Aset Kayamas had a connection with his official duties.
The offence was allegedly committed at the Pusat Bandar Damansara branch of CIMB Bank Bhd on June 14, 2016.
Defence reiterates RM2m was political donation
Tan, in his submission, argued that the RM2 million was in fact given by Chai for political donation and this was confirmed by the businessperson during the trial.
In the witness statement, Tan said Chai testified that the RM2 million was his contribution to Tengku Adnan after the latter said he needed a political fund between RM5 million and RM6 million for two by-elections - Sungai Besar and Kuala Kangsar.
"It must be emphasised that this is the witness statement of SP19 (Chai), the star witness for the prosecution, and he had clearly testified in examination-in-chief that he would issue a cheque as a political donation to Umno.
"In cross-examination, SP19 confirmed that the sum of RM2 million was a political donation to Umno and not for the appellant (Tengku Adnan)," he said.
However, Asmah stated that Chai had no knowledge of whether the RM2 million would be used for the purpose of political activity as the cheque given by Chai was to Tadmansori Holdings, not Umno.
She said this was added by the fact that Chai was not involved in the by-elections and therefore could not verify that the money given to Tengku Adnan was used for the polls.
"This clearly shows that the RM2 million was requested as a political donation, was based on what the appellant told SP19 (Chai)... but the money trail (showed) that the money never reached Umno for by-election purposes," she said.
