Court awards RM652k to man who lost leg after falling into pothole

The Kota Bharu Sessions Court yesterday awarded damages of RM652,000 to a man whose left leg was amputated after he fell into a large pothole filled with water, in an incident two years ago.

Judge Mohd Zul Zakiqudin Zulkifli delivered the decision after the court found the government’s road maintenance contractor was negligent in the matter.

Tengku Muhamad Khazi Hakimi Ku Hussin, 34, fell into the pothole on Dec 1, 2019, at KM53 of Jalan Kota Bharu-Kuala Krai in Machang.

His counsel Wahab Che Kob and Nor Asmiza Husin said the claims were made against Roadcare Malaysia Sdn Bhd and the government.

In earlier proceedings, Khazi’s (above) lawyers said Roadcare denied the existence of the pothole.

"But the court found, based on evidence and testimonies, that the accident happened because the pothole was filled with water, and this was due to negligence by the defendants, Roadcare as maintenance contractor to the government," they told Malaysiakini today.

The defendants were represented by S Siva Shanker and Asmah Che Wan.
