Zaharin Osman alleged that the case, which took place in 2021, was still pending in the Kulim Magistrates’ Court.
“Khairul had stated that the court had acquitted him on March 28 this year, when the court only discharged him not amounting to an acquittal.
“This was due to a technical error where I, as the complainant, was not subpoenaed for any of the court mentions.
“Because of this, the case had not reached trial as the witness and I were never subpoenaed,” he said.
Zaharin claimed that the deputy public prosecutor had then applied for a discharge not amounting to acquittal (DNAA) pending further charges.
Khairul previously said that he was in a court trial for 18 months and was acquitted of the charges on March 28 this year.
“I had to go through the court trial for 18 months but on March 28 this year, the court acquitted me of the charges,” he had said.
However, Zaharin claimed that the case could not go to trial as the investigating officer handling the case failed to subpoena witnesses to attend the hearing.

On Aug 2, Khairul claimed that the man in the video - whom Zaharin has claimed to be - hurled foul words towards the Lunas candidate’s wife and wanted to enter the office with his shoes on to “take away items that were for the purpose of helping the people”.
Referring case to MACC
Zaharin refuted this claim, claiming that Khairul had denied the former’s right to help with donations of goods.
“As the Padang Serai Bersatu division committee member, I went to the division’s office on May 6, 2021, to collect a donation of basic goods.
“However, the division chief at the time, Khairul, denied my right to help with the donation. On that day, Khairul expressed his displeasure towards me for asking for my share (of goods to donate). I was standing at the front entrance of the premises.
“Out of the blue (Khairul) using his both hands had pushed me with the intention to injure, causing me to fall backward and sustain injuries,” he said.
He said that Khairul was then charged on Sept 12, 2021, under Section 334 of the Penal Code.
Zaharin today said that he would refer his case to the MACC to investigate if there were external influences delaying the process or protecting any individuals involved in the case.
“I also hope that this case can be resolved as soon as possible because it has been two years.
“I also will not hesitate to sue certain individuals who have defamed my name and family and as there is also a security threat to myself and my family members.
“With the explanation of this incident, it is hoped that all parties will get true and accurate information regarding the case that has gone viral on social media,” he added.
Khairul previously said that he would take legal action against several individuals and media publications for defamation after the video made rounds on social media last week.
Khairul: I won’t ‘layan’
Speaking to Malaysiakini, Khairul refuted Zaharin’s claims, insisting that the court case against him has concluded.

Khairul, who is also Kedah PN information chief, accused BN of being the “mastermind” of this matter ahead of polling day this Saturday.
“These are talks of desperate people and they are using others to make such statements. I can see that this group is very desperate to tarnish my image. I am not interested to play along (melayan).
“I am a leader, I would not make a statement if it’s not true.“Until now, I have not been called for prosecution and we abide by the orders of the authorities,” he told Malaysiakini.
Asked if he could furnish documents as proof that the court case against him has concluded, he said he would have to consult his lawyer.
“I’m not sure if there are documents or not. I didn’t take it at court that day, I will check with my lawyer.”
