1MDB bond settlement: Lawyer files to nullify MACC court bid

A lawyer whose law firm MACC raided earlier this month has filed to strike out the antigraft agency’s court bid to obtain client-confidential documents regarding the 1MDB bond settlement deal between Goldman Sachs and Malaysia.

Rosli Dahlan filed the striking-out application at the Kuala Lumpur High Court last week, on the contention that MACC exceeded its authority and power, among others.

Following the raid on Oct 6, MACC had filed an application at the Kuala Lumpur High Court for a court order to compel Rosli Dahlan Saravana Partnership (RDS) to hand over several documents in the probe into a settlement entered between Goldman and the government on the 1MDB bond issue.

According to Rosli’s cause papers to back the striking-out, the lawyer claimed that MACC’s application was an abuse of the court process as it contained material, procedural and substantive defects which rendered the bid bad in law.

The lawyer also contended that MACC’s bid was driven by bad faith and malice for naming him as one of the two respondents (the other respondent is RDS) because none of the documents sought by the agency even relate to him.

Under the law, a successful striking-out bid means the targeted application would not be subjected to a full hearing by the courts.

Rosli's nullification bid is set for further case management before the Kuala Lumpur High Court tomorrow.
