Apex court upholds PN's electoral victory in Masjid Tanah
The Masjid Tanah parliamentary constituency remains with Perikatan Nasional as the apex court has dismissed BN’s appeal in an election petition.
A three-person Federal Court bench chaired by judge P Nallini unanimously denied BN candidate Abdul Hakim Abdul Wahid’s appeal targeting PN lawmaker Mas Ermieyati Samsudin’s victory in the constituency during the 15th general election.
The Masjid Tanah parliamentary constituency remains with Perikatan Nasional as the apex court has dismissed BN’s appeal in an election petition.
A three-person Federal Court bench chaired by judge P Nallini unanimously denied BN candidate Abdul Hakim Abdul Wahid’s appeal targeting PN lawmaker Mas Ermieyati Samsudin’s victory in the constituency during the 15th general election.
The other members of the apex bench were Mary Lim Thiam Suan and Abu Bakar Jais.
The apex court ruled that there was no evidence of voters being persuaded, influenced, or induced to vote or not to vote in a particular manner.
On Oct 27 last year, the Malacca High Court dismissed BN’s petition to nullify PN’s electoral victory in the Masjid Tanah seat in late 2022.
Election Court judge Abu Bakar Katar found there was insufficient testimony to back the petitioner’s claim.
Previously, the BN candidate alleged there was corrupt practice during the GE15 campaign period.
On Sept 25 last year, it was reported that the election petitioner failed to call key witnesses for the trial.
Earlier on Feb 7 last year, the High Court struck out BN’s election petition when it allowed PN’s preliminary objection.
However, on appeal, the Federal Court ordered the election petition be sent back to the High Court for a full hearing of its merits.
