Tajuddin's aide denies court bailiff entry to execute writ of seizure

A court bailiff was denied entry to the home of former Umno MP Tajuddin Abdul Rahman earlier this morning to execute a writ of seizure and sale by former Shah Alam MP Khalid Samad.

The bailiff Marzuki Mohamad was there following a Court of Appeal decision on Oct 19 last year ordering Tajuddin to pay Khalid RM60,000 in costs, according to Free Malaysia Today.

This was regarding the former’s defamation suit against the latter, which the High Court had dismissed without ordering costs.

Lawyer Wong Guo Jin of law firm SN Nair & Partners, representing Khalid, was reported as saying that despite the formal demands made, Tajuddin (above) had refused to pay up.

“Then, Khalid obtained a writ of seizure and sale from the Kuala Lumpur High Court on Apr 16, and attempted to execute the writ today via the High Court’s bailiff at Tajuddin’s house in Bukit Damansara,” he said.

Wong said his team, who accompanied the bailiff this morning, had arrived at Tajuddin’s house at 9.40am and was greeted by a person named Firdaus Mufazal Faiz, who referred to himself as Tajuddin’s officer.

Firdaus refused to allow them in, claiming Tajuddin was not at home and that the residence belonged to the former Pasir Salak MP’s wife.

“Firdaus contacted the defendant’s lawyer to inform him that the plaintiff’s lawyer and I had arrived to execute the writ of sale and seizure.

“He then asked me to delay the execution, but I said I had no power to do so unless he gave me a court order stating that it had to be delayed,” Wong explained.

Tajuddin’s defamation suit dismissed

Wong added that as the bailiff’s attempt today was unsuccessful, Khalid would make another ex parte application with the court for another attempt.

On Oct 19, Court of Appeal allowed an appeal for Tajuddin to pay RM120,000 in legal costs to Khalid and KiniTV.

A three-person bench chaired by M Nantha Balan and comprised of member judges Mohd Nazlan Mohd Ghazali and Choo Kah Sing unanimously allowed the appeal by Khalid and KiniTV during open-court proceedings this morning.

The appeal is linked to the Kuala Lumpur High Court ruling last year that dismissed Tajuddin’s defamation suit against the two appellants but did not make any order on costs.

Nantha ruled that the lower court only gave a brief explanation of why it did not award costs to any party and did not give full grounds over its justification for not awarding costs in the matter.

The bench then directed Tajuddin to pay RM60,000 in costs to each of the two appellants, namely Khalid and KiniTV.
