High Court rejects bail for senior cop charged with student's murder

The Ipoh High Court today rejected the bail application of a senior police officer charged with murder following a fatal traffic incident involving a secondary school student.

Judge Bhupindar Singh Gucharan Singh Preet dismissed Mohd Nazri Abdul Razak’s request for bail, saying the court found no exceptional circumstances that would warrant the granting of bail and maintained the trial date of Nov 4, which was set previously.

During the proceedings, the prosecution was represented by deputy public prosecutors Afzainizam Abdul Aziz, Nasrul Hadi Abdul Ghani, and Low Qin Hui, while the defence was led by lawyers Jacky Loi, Lim Chi Chau, Lim Jin Wen, Cindy Wong, and M Kuhan.

Lawyer Wan Azmir Wan Majid held a watching brief for the victim’s family.

Nazri, 44, is charged with causing the death of 17-year-old Muhammad Zaharif Affendi Muhd Zamrie near SMK Jati on Dec 15, between 12.05pm and 12.40pm.

He is charged under Section 302 of the Penal Code, which carries the death penalty or a minimum of 30 years and up to 40 years in prison, and if not sentenced to death, may be subjected to a minimum of 12 strokes of the cane.

On May 14, Nazri pleaded not guilty at the High Court, which set the trial to run from Nov 4 to Jan 17 next year.

During proceedings, defence lawyer Loi said the case presented by the prosecution has yet to show that Nazri had committed an offence punishable under Section 302 of the Penal Code.

“The narrative of the case shows that the applicant (Nazri) was at the scene because his wife works as a teacher at the school and that he was not known to the deceased,” he said.

Afzainizam, meanwhile, argued that the charge and case narrative contained material facts indicating that the applicant was involved in the alleged murder of the student on Dec 15, 2023.
