GISBH member who knelt on boy's chest jailed 10 years for abuse

A 23-year-old member of Global Ikhwan Service and Business Holdings (GISBH) has been sentenced to 10 years in jail after pleading guilty to causing physical injuries to three children, aged between 10 and 12, under his care.

Muhd Barur Rahim Hisam’s admission to the four charges under Section 31(1)(a) of the Child Act 2001 was heard before Klang Sessions Court judge Noridah Adam today.

In three of the four charges, Barur Rahim admitted to causing physical injury by caning a child under his care.

He also admitted to a fourth charge of causing physical injury by kneeling on the chest of a boy under his care.

The offences were committed at a GISBH-operated religious school in Bukit Raja, Klang, and a charity home.

Section 31(1)(a) of the Child Act 2001 criminalises the act of neglecting, abandoning, or exposing a child to danger in a way that could cause physical or emotional injury, essentially making it an offence for a caregiver to put a child at risk of harm, even if no injury occurs.

Offenders can face a hefty fine and imprisonment.

In mitigation, Barur expressed regret for his actions and promised never to repeat the offence.

”I’m not married but I am taking care of my parents, so if it’s possible, I’d like to request a lenient sentence,” he said.

However, deputy public prosecutor Kalmizah Salleh argued six factors in requesting a maximum sentence, including the impact of the injuries on the victims.

Noridah then sentenced Barur to two years in jail each for the first and second charge, and three years in jail each for the third and fourth charge, to be served consecutively beginning from his date of arrest on Sept 11.

Barur, who was unrepresented, was also served with a five-year good behaviour bond with RM10,000 surety.
