PAS will set up a counter to provide legal assistance to those who get summonses under the Automated Enforcement System (AES) at its headquarters at Jalan Raja Laut, Kuala Lumpur, starting Nov 21.

NONE According to PAS vice-president Mahfuz Omar, those affected can bring their summonses to the counter which will be open from 11am to 1pm.

“Subsequently, the counter will be opened at the PAS headquarters fortnightly on Saturday,” he told reporters at the Parliament lobby.

As such, he urged those who have received AES notices not to pay the compound and to go to court over the matter, with free legal assistance from PAS lawyers.

“But if the court instructs them to pay then they must,” he said.

 He said that those in Kedah can bring their summonses to the Kedah PAS headquarters at Batu Sembilan while those in Perak can send a text message to the hotline 019-3293848.

The service is also extended to Transport Ministry, Road Transport Department (JPJ) and police personnel, he said.

He added that the first court case to be fought by PAS lawyers on this matter will be on Dec 7, 2012 at the Kuala Lumpur magistrate’s court.

He said that thus far, 50 people have contacted them on the matter in Kuala Lumpur alone, including one individual who was fined for driving at 91kph along the Kajang-Puchong Road.

He claimed that last week, the JPJ website had stated that the speed limit there is 90kph, but earlier this week took out advertisements in Harian Metro to say a mistake was made.

“Now they say the speed limit there is 80kph. So add this to the GPS coordinates which told us that the cameras are in the middle of the sea, we can say there are problems with the system,” he said.

Judicial review

Mahfuz said that PAS lawyers are also in the midst of preparing to file a judicial review against the AES.

“In particular, we are focusing on the agreement with the AES contractors, insofar as them getting a share of the compound and fine.

“We feel that the companies should be paid a fee (instead of a share of the compound collection), and all the collection should go into a government consolidated fund,” he said.

Deputy Transport Minister Abdul Rahim Bakri had earlier told Parliament that contractors ATES Sdn Bhd and Beta Tegap Sdn Bhd will profit through the following three-step formula:

  • RM16 for each summons up to five million summons;
  • 50 percent of the summons value for the remainder, up to RM270 million a year;
  • 7.5 percent of the summons revenue for the remainder of the revenue.
