Two former PAS lawmakers who have joined Parti Amanah Negara (Amanah) will pay kafarah , a form of donation, by feeding the poor in Shah Alam tomorrow.

Shah Alam MP Khalid Samad and Kota Raja MP Dr Mariah Mahmud ( photo ) will be performing the act to redeem an oath of loyalty they swore to PAS.

Kafarah is typically a donation made when one misses fasting during Ramadan and is unable to replace it. It is also one of the three ways one can redeem oneself after breaking an oath.

The other methods of redeeming broken oaths are by fasting, and the now defunct act of freeing a slave.

"We believe Allah is just and all knowing, we did not make the oath for personal reasons as such we dare to (break it)," Khalid said at a press conference in Shah Alam today.

He said 100 poor people will be fed lamb briyani at Dewan Merbau in Shah Alam tomorrow night.

PAS' bai'ah is meant to deter MPs and assemblypersons from PAS from jumping ship.

Forced to swear the oath

It is believed that each state has its own oath, with the most controversial being the ones in Kelantan and Terengganu, which includes a divorce clause.

Commenting on how this will affect Kuala Krai MP and fellow Amanah member Dr Hatta Ramli , Khalid said the oath was invalid.

Quoting Hatta ( photo ), Khalid said the Kelantanese MP was forced to swear the oath, and was just following orders.

"Hatta's stance is that this is not valid... and we find it strange that the syariah court has passed judgment before hearing Hatta's arguments," he said.

Syariah Lawyers Association president Musa Awang said regardless of what Hatta's stance is, such matters must be brought to syariah court to determine whether the oath is binding.

"Only the courts have the power to make a decision, not anyone else. It can't simply be decided... the PAS lawmakers need to go to the syariah court to see whether the divorce clause is binding," Musda told Malaysiakini when contacted.
