Former Kuala Lumpur CID chief Mat Zain Ibrahim says Annuar Musa can be investigated for providing false information on Facebook, which resulted in police reports being filed against Dr Mahathir Mohamad, as well as be investigated for criminal defamation.

Mat Zain said he had compared Mahathir's blog posting on Feb 3 and the Facebook posting of Annuar, who is Umno information chief, as reported by various media.

He told Malaysiakini that the critical point in Mahathir's blog posting, as he had read in the media, was this part, where the former prime minister wrote:

“The current AG, with whom the Swiss AG seeks cooperation, was appointed by the PM through false representation made to the King. This means the AG owes to the PM his position. Can he be expected to charge the person to whom he owes his position?

“Knowing his predecessor was dismissed for trying to do the same, the new AG is not likely to prefer a charge against the PM. Hence his dismissal of the reports by Bank Negara and the MACC. He is therefore unlikely to provide the Swiss AG with any evidence which may incriminate his employer.”

Mat Zain said: “For whatever reasons Annuar ( photo ) may have had in making the Facebook postings in question, I have to say that he had given false information under Section 182 of the Penal Code, with intent to cause a public servant to use his lawful powers to the injury of another person.

“Annuar can also be said to have instigated and/or abetted several complainants to lodge reports against Mahathir that the information (as given by Annuar) will cause the IGP Khalid Abu Bakar to commence investigation against the former prime minister.”

The former top cop said Annuar, in his Facebook posting had alleged that Mahathir had deceived the Yang di-Pertuan Agong by saying that it was Najib Abdul Razak, now the prime minister, who had misrepresented the facts to the Agong.

With the statement, Mat Zain said, Annuar had not only tried to cover up for Najib, but also made a false accusation against Mahathir that resulted in a few people to lodge police reports against the 91-year-old former head of government, leading to Khalid commencing the investigations.

In agreement with Dr M

Mat Zain said he agreed with what Mahathir wrote.

“Although I have been quite critical of Mahathir's views on certain matters, I am on the same page with him where this particular issue is concerned.”

It was previously reported that Annuar had posted on Facebook that he found Mahathir's posting seditious.

This resulted in Khalid ( photo ) last week asking those who were unhappy with Mahathir’s blog posting to lodge police reports .

On Monday, the IGP said in Penang that several police reports have been lodged against Mahathir.

This led to Mahathir making another blog posting, in which he revealed that he believed there were those who wished to see him behind bars.

Annuar, who is Ketereh MP and also chairperson of Mara, had suggested that Mahathir wanted to be arrested.

“That is as clear as a warning can be, of the wish to arrest me," Mahathir had written on his blog.

'Evidence shows concealment of facts'

Mat Zain further claimed that there was evidence to show concealment of material facts and misrepresentations to the Agong had been done before, and was being done now as well.

He added that a copy of this evidence had been handed to Najib and even to attorney-general Mohamed Apandi Ali last month.

He would not mind giving a copy of the above documents to Mahathir, if he so wished. The last time he met the former prime minister was three years ago, at a discussion on the Pulau Batu Puteh issue.

Mat Zain said with investigations against Mahathir still going on, he would refrain from making further comments on the matter, but reserved the right to decide if he would lodge a report against Annuar for the crime of giving false information.

Under Section 182, a person giving false information can be jailed for up to six months or be fined up to RM2,000, or both.

One of the alleged facts hidden from the Agong is that Najib concealed that there is/was an ongoing investigation against then AG Abdul Gani Patail ( photo ), when he sat on the Pardons Board during the hearing of the application from Anwar Ibrahim's family on the Sodomy II conviction on March 16 last year.

It is said that an order to investigate Gani was made on Jan 3, 2014, and a new order to investigate was given on March 31, last year.

Such documents, Mat Zain disclosed, were also given to Najib last year and to the solicitor-general as well.

This, Mat Zain claimed, was hidden from the Agong when Najib applied to terminate the services of Gani. Health reasons were cited by chief secretary to the government, Ali Hamsa, as the cause for Gani’s termination as attorney-general.
