LETTER | The Joint Action Group for Gender Equality (JAG) welcomes the landmark decision by the Federal Court in M Indira Gandhi’s case.

We commend the Federal Court’s bold action in exercising justice and integrity in addressing this case. The decision not only upholds the supremacy of the Federal Constitution, but also embodies its spirit in upholding justice.

The Federal Court decision makes absolutely clear that it is the civil High Court that has jurisdiction to hear this case involving the validity of the conversions of minors.

We applaud the Federal Court decision in considering the paramount interest of the child, and how such conversion may affect the child and their upbringing.

The conclusion of this case marks a monumental moment in our history and we hope that Indira Gandhi would be able to be swiftly reunited with her daughter. This decision is a testament to Indira’s perseverance in enduring this uphill battle which has finally come to an end after a decade.

JAG is hopeful that this decision signifies the beginning of building a more equitable country. JAG urges that the police and immigration officers to take action to hasten the reunification of Indira with her daughter.

JAG also urges that Muslim groups to respect the decision of the Federal Court, and to uphold the decision of the court in a dignified manner.
