The rebel camp of the three-month-old Malaysian Makkal Sakthi Party (MMSP), has taken their `sacked’ president RS Thanenthiran ( below ), to the Kuala Lumpur High Court for allegedly forging the party constitution to stay in power.

suaram human rights award 091208 rs thanenthiran The rebel camp of 14 central committee members include deputy party president A Vathemurthy and party secretary general R Kannan. They were recently sacked by Thanenthiran for rebelling against him. The suit was filed at 11am today.        

Their contention is that they had already sacked the president earlier, thereby depriving him of the power to do same to them. 

Instead, they allege he had forged the party constitution allowing him to remain in office.

Kannan told Malaysiakini this evening that the suit also included the Registrar of Societies (ROS) and two ROS deputy registrars.

 

He added:  “Thanenthiran had amended three clauses 7(2), 9(1) and 10 (1) of the 24-page party constitution to give him full power to appoint and sack members without referring to the party’s central committee.”

Membership termination

According to Kannan, clause 7(2) deals with the termination of membership, clause 9(1) deals with the structure of the party and clause 10(1) deals with the power of the president.

The unhappy members are seeking a declaration for judicial review to quash any decision made by the president based on the allegedly forged party constitution.

They also want ROS to give a declaration on the original constitution of the party and also want it to explain why they aprpoved two versions of the party constitution.
