Perak DAP will be making legal history on Friday when it lodges a police report accusing former Malim Nawar assemblyperson Keshvinder Singh of cheating those who voted for him.

Party national labour bureau chief A Sivanesan told Malaysiakini today that he and DAP Keranji assemblyperson Chen Fook Chye, will be leading other party members to lodge the report under Section 415 of the Penal Code for cheating, at the Malim Nawar police stationon Friday at 11am.

Sivanesan claimed that this is the first time in the nation's history that a cheating case has been lodged against a politician for jumping ship to become a BN-friendly Independent.

The DAP state vice-chairman-cum-lawyer claimed that Keshvinder has committed a cheating offence against his voters when he won his state seat on a DAP ticket and later jumped ship, thus abusing the trust and confidence of his constituents.

He criticised the former party branch chief of Malim Nawar as a ‘ lalang ' (weed) who at one time was a strong critic of Menteri Besar Zambry Abdul Kadir during the political turmoil of the state

assembly sittings last year but now chooses to sing praises of the Umno state chief.

"If Keshvinder is really genuine in resigning from DAP then he should have held the media conference in Malim Nawar among his voters, stating the reasons for his leaving the party.

"However, he gave room for suspicion that he had other personal agendas when he chose the venue in Subang Jaya, being escorted by two bodyguards and not giving proper answers to the questions raised by reporters," reasoned Sivanesan, who is also Sungkai assemblyperson.

"He should go public and give an explanation for abandoning his voters who voted for him on our party ticket.

"I made this challenge to him to come to Malim Nawar at 11am on either last Saturday or Sunday to justify why he jumped ship to his voters but he never turned up."

DAP has more legal ammunition to fire at the former party member for deserting the party.

m moorthy 301205 a sivanesan Sivanesan ( left ) added: "We are now studying the legal implications before filing civil suits against both Keshvinder and Hee Yit Foong (the former DAP Jelapang assemblyperson) for compensation of RM5 million each to be paid to the party for resigning."

According to state party chief Ngeh Koo Ham, all elected representatives of DAP have signed agreements that each of them has to pay compensation of RM5 million to DAP if they leave the party.

DAP is holding another mammoth party gathering at Malim Nawar on Friday at 7.30pm. Top party leaders including Lim Kit Siang and Karpal Singh are expected to attend.

The party is also expected to go on a house-to-house signature campaign among Malim Nawar voters to pressure Keshvinder into vacating his state seat so that a fresh by-election can be held.
