The Kuala Lumpur Sessions Court has allowed a postponement in the Shamsubahrin Ismail cheating trial, which is now fixed for hearing from July 16-27.

The postponement is to allow the prosecution and defence to wait for the outcome of a representation application sent by Shamsubahrin's lawyers to drop or reduce the charges .

Abdul Razak Musa, head of prosecution at the Malaysian Anti-Corruption Commission (MACC), informed the court about this.

NONE He also said the prosecution needs time to verify the transcript of text-message exchanges between Shamsubahrin (left in photo) and National Feedlot Corporation (NFC) chairperson Mohamed Salleh Ismail.

Defence lawyer Sallehuddin Saidin said his client had given a statement, as well as handed his handphone and a copy of the transcript to the MACC.

"The representation was sent on March 13 (to drop or reduce the charges), so the MACC and chambers may need time to study it," he told the court this morning.

Judge Rozilah Salleh then allowed the postponement, also setting May 21 for mention of the case.

azlan Shamsubahrin, 45, has claimed trial to two counts of cheating under Section 420 of the Penal Code.

He is accused of cheating Mohamed Salleh (left) into handing over cheques exceeding RM1.755 million at Solaris Mont Kiara between Nov 25 and Dec 6, 2011.

He is also charged with having cheated Mohamad Salleh on Nov 20, 2011 by promising to provide ‘consultancy services’ in return for a fee, although he allegedly knew he could not deliver this.

Abdul Razak told reporters outside the court that a representation may not necessarily result in charges to be dropped or reduced as at times it can enhance (further) the charges.

He also explained that the SMS text given by Shamsubahrin only contained the SMS he received and does not have those which he had sent.

“We had sent the handphone to Cybersecurity to retrieve the SMS and check it,” he said.

"I was made to understand Cybersecurity has problems retrieving it so we have to wait,” he added.

Although Shamsubahrin has been charged earlier, Mohamed Salleh was charged last month with criminal breach of trust.

Mohamed Salleh is the husband of Women, Family and Community Development Minister Shahrizat Abdul Jalil.
